도시재생시대의 학교 이전·재배치 촉진 방안 탐색 : 법제적 접근

Abstract

Under the influence of low birthrate, the number of students was continually on the wane, and in 2030, those of primary and middle school were reduced respectively to 40% in 2007, and the number of students in high school to the level of 46%, so the number of students is expected to decrease seriously, but developing projects is continuously under progress, and the bi-polarization of the number of students according to the transfer of students to new cities and the reduction of the number of students at the center of old cities is expected to continue. In order to correspond to this, the government is propelling the policy to grow schools of appropriate scales that include school relocation and merge since 2009, but the results are insignificant, and at present,「ACT ON THE SPECIAL CASES CONCERNING THE PROCUREMENT, ETC. OF SCHOOL SITES」is stipulating only the exemptions of new school establishments, so it is true that it is difficult to be applied to school relocation project for dramatic reduction of the number of students at each community and resolution of bi-polarization of the gap between the number of students, etc. Therefore, this paper studied the major contents of special bill that enables to propel school relocation of the schools at the old city centers for systematic and effective propulsion of school reallocation project. The major contents of special bills are first, the urban & provincial educational superintendents and the mayor & governor shall establish the total plan for school relocation to plan the case in advance in which school relocation is required to reflect them on the urban, county basic plan established every 20 years, and urban, county management plan established every 5 years, and second, suggesting the criteria for school location so that good educational environment may be secured, and the developing operator shall discuss school location before establishing the development plan, and third, exemptions as to the financial support of the nation or local administration shall be stipulated to activate reallocation. Furthermore, when propelling urban regeneration project such as redevelopment or reconstruction to be continuously on the rise in the future, school friendly urban regeneration plan was suggested so that the city could be planned educationally friendly from the stage of establishing the plan of development.
