우리나라에서 법집행담당자인 경찰, 검사, 판사 집단은 아동학대 예방부터 조기발견, 초기 대응 및 사후 조치에 이르기까지 전 과정에서 핵심적인 역할을 담당한다. 그럼에도 불구하고 이들 집단에 대한 아동학대인식연구가 전무한 형편이다. 이에 본 연구는 이들의 아동학대에 대한 인식을 파악하여 아동복지의 정책 및 임상적 함의를 모색하고자 하였다. 본 연구의 목적을 위해 여성․아동 전담검사 51명과 판사 54명, 그리고 여성․청소년계 경찰 85명을 포함한 총 190명을 대상으로 2011년 12월말부터 2012년 2월말까지 우편조사를 통한 자기기입식 설문조사를 수행하여 아동학대에 대한 인식도 및 영향요인을 파악하였다. 주요 연구결과는 다음과 같다. 첫째, 심각한 아동학대 행위에 대해서 90% 이상의 검사 및 판사가 명확한 학대라고 인식하고 있었으나 경찰은 보다 유연하게 인식하였다. 둘째, 가벼운 신체학대, 정서학대, 방임에 대해서는 항목에 따라 인식도의 차이가 컸으며, 검사․판사․경찰 간 인식도의 차이가 두드러지지 않았다. 셋째, 법집행담당자의 가벼운 신체학대, 정서학대 및 방임 인식도에 대한 가장 큰 영향요인은 아동학대교육 참여의사로 나타났다. 이러한 결과를 바탕으로 법집행담당자의 아동학대에 대한 민감성 증진 및 아동학대 개념에 대한 사회적 합의를 도출하기 위한 함의를 논하였다.
Abstract
Despite the important roles the law enforcement authorities play in the prevention, early detection, initial responses, and after care actions of child abuse, only limited number of literatures are available on their perception of child abuse. This study focuses on evaluating the level of perception on child abuse among police officers, prosecutors, and judges and makes suggestions for child welfare policy and practice. This study recruited 190 participants, which include 51 prosecutors who were in charge of child and woman cases, 54 judges, and 85 police officers who are in charge of woman and youth cases. Data were collected from December 2011 to February 2012, using self-administered questionnaires by mails and e-mails. The results of the study are as follows: First, more than 90% of prosecutors and judges responded as ‘definitely abuse’ on items that described severe abuse while police officers responded more lenient way. Second, there were no group differences on items related to minor physical abuse, emotional abuse, and neglect. Third, intention to participate in child abuse training was identified as the most influential predictive factor for minor physical abuse, emotional abuse and neglect. Based on the results, implications were discussed to increase child abuse sensitivity and to draw social consensus on child abuse.
