초록
The intention of this article is to study the modern meaning through discussion of Confucian laws and institutions under the theme of "the intersection of Confucianism". To do this, we look at the norms and social institutions found in Xunzi and Mencius. Mencius inherited and developed the concept of domination of the king's ethics based on mercy (righteousness), and Xunzi succeeded and developed the concept of conscious domination relatively. The results of examining Confucian theory in the essential sense of the relationship between humans, society and nature are as follows. First, ritual and law are both forms and must be separated from reality. Second, the social norms of customs, laws, and ethics complement each other and play a role in conformity with the actual situation, but if they deviate from the original concept, they become rigid and lead to contradictions. Finally, the real situation is that it is difficult to confirm the view of blindly conforming to nature or unconditionally trusting the morals of people, such as primitive religious thinking, and it is also difficult to ensure the individual independence of various people in reality based on this premise. In this regard, Xunzi's primitive Confucian thoughts now inspire us a lot.
