정보 통신과 디지털 기술의 발달은 정보 통신기기 등과 같이 업무적, 일상적으로 접하는 제품들의 기능을 복잡하고 다양하게 변화시켜, 이들 기기의 인터페이스 기능을 담당하는 UI 디자인의 중요성이 날로 증대되고 있다. 기업에서는 경쟁시장에서의 우위를 점하기 위하여 각종 제품의 외형 디자인과는 별도로 UI 디자인만의 개발에 많은 인력과 비용을 투자하고 있는 실정이다. 최근 애플사를 중심으로 불거지고 있는 글로벌 특허 분쟁에서 UI디자인과 관련된 기술 특허와 디자인 특허, 상표와 트레이드 드레스 문제는 그 핵심 쟁점으로서 활발하게 논의되고 있다. 이러한 시점에서 본 논문은 UI 디자인과 관련된 각 법률이 지닌 보호의 가능성과 실질적 한계를 살펴보고자 했으며 나아가 UI디자인과 관련한 이용저촉관계가 발생한 경우, 그 권리의 보호범위에 관해서 논의해 보고자 했다. 결론적으로, 복합디지털 생산물로서의 UI 디자인은 어느 하나의 제도에 의해 완벽한 보호가 이루어질 수 없으므로, 앞으로 그 보호 방법에 대한 대안론의 연구는 더욱 절실할 것이라 생각된다. 따라서 본 논문은 이러한 연구의 시작으로서, 디자인 업계로부터의 전문적인 기반 연구의 필요성을 제기하고자 한다. 이를 위한 우선적 사안으로 새로운 디지털 디자인 분야에 대한 권리를 보호함에 있어 디자인 사례별 유사성 판단 기준, 침해 업체의 디자인 모방의 의도성 판단 기준, 자유로운 디자인 경쟁의 기회를 박탈하는 특정 기업의 독점을 제한하기 위한 보편적 디자인 지침의 기준, 디자인 컨셉의 포괄적 인정 등으로 정리할 수 있었다.
Abstract
As the advancement of information technology and digital technique brought many complicated and diverse changes to the function of ordinary products in our everyday life, the User Interface design having a key part in the function of interface between these products and human-being is getting more and more important. Some companies are investing manpower and expense in the development of UI Design separately apart from the appearance design of product in order to take a high position from competitive market. Recently, In global patent dispute centered in Apple Inc. the issues of technical patent, design patent, the trademark and trade dress which relate with UI designs are discussed actively as controversial subjects. At this critical juncture, the present research question emerged from the questions: whether UI design is protected fully or not according to domestic law. So, this paper examines the issues of the law related with UI designs. The aim of this study is to provide an necessity of criteria for evaluating design similarities, judgement of design copy, average design standard, protection of design concept, and so on.
