본 논문은 대동법 하에서 정부의 소용물자를 조달하는 공인을 제도적 관점에서 이해하기 위해 먼저, 공인과 정부 간의 거래를 비시장경제의 논리로부터 설명하고 공인제도가 지속될 수 없었던 내재적 요인을 살펴보았다. 정부와 공인 간의 거래는 호혜성에 기초한 인격적 거래였다. 이 거래는 높은 貢價를 지불할 수 있는 정부의 재정적 능력과 정부와 공인 상호 간의 성실한 이행에 기초하고 있다. 그러나 공인은 공가를 당겨 받고 미납을 발생시키며, 정부는 공인에게 과중한 역을 부과하거나 재정압박에 직면하여 공가를 감하거나 지급하지 않는 약탈적 모습을 보였다. 다음으로, 비시장경제적 거래양식의 지양 및 시장경제의 출현이라는 점과 관련하여 공인집단의 성격을 살펴보았다. 시장경제의 제도적 기초는 배타성과 자율성, 그리고 응집력이 강한 상인집단 속에서 자생적으로 형성되었다. 그러나 공인 중에는 공인집단인 都中에 속하지 않는 자도 있고 공인권의 분할·상속·매매는 자유로웠으며 도중 소속의 공인조차도 변동이 심하였다. 따라서 도중을 서양의 상인길드처럼 자율적이고 폐쇄적인 규약을 가진 동업자조합이자 시장경제를 주도할 수 있는 상인집단으로 보기는 어렵다.
Abstract
This paper aimed to understand Kong-in who was a merchant to supply the necessary materials to the government in the late Chosŏn. Firstly, The transaction between Kong-in and government and the intrinsic factors to make Kong-in system unsustainable were explained on the logic of non-market economy. It was a personal transaction depending on the financial ability to pay for above the current price and the confidence in the sincere fulfillment of the transaction between both sides. However, being paid in advance, Kong-in might fail to provide the materials to the government and the latter also asked the former more extra service and cut down or postponed the payment. Secondly, Kong-in was studied in that merchant’s community was the prime mover of the market economy. The basic institution of the market economy was formed voluntarily by the merchant’s community which was exclusive, self-regulated, and strongly cohesive. However, Do-jung, that is Kong-in community, was not such that all of Kong-in weren’t included, the Kong-in’s right was unconstrainedly divided, inherited, sold and bought, and members were frequently changed.
