Abstract
FTCA(Federal Tort Claims Act) do not permit any claim arising out of the combatant activities of military or naval forces, or the Coast Guard, during the of war in §2680(j). This section has applied to the cases that the injuries arose out of or were in the course of activity incident to service through the cases of the Supreme Court. The first of those cases was Feres v. United States, 340 U. S. 135(1950). Feres Doctrine has been expanded to cases that the injurer was the member of armed forces that a private party claimed for national indemnity about the portion of joint tort action incurred by member of armed forces. These cases do not correspond the idea of FTCA that protects from the tort committed by employees of federal government activity. So the §2680(j) should be interpreted as limitedly as possible.
