Abstract

The private military and security companies(PMSCs) means the companies to provide military and security service, it’s use has greatly expanded, will also be expected to be increased in the future. In result, international communities will be predicted to meet with many troubles related to PMSCs. In light to this situations, international communities must make various efforts for the regulations of PMSCs. As one of the efforts, it is one of urgent tasks to clarify the legal status of PMSCs employees. Because confirming the legal status of PMSCs employees roles as a useful starting point for legal solution of PMSCs issues. Therefore, this paper deals with the following aspects. First, the general characters of PMSCs is introduced synthetically. Second, after classifying PMSCs employees as belligerent, mercenaries or civilians, each case is analyzed. Third, the directions of PMSCs would be proposed in the conclusion. Based on the above reviews, the following conclusions are reached, which are follows. First of all, in case of classifying PMSCs employees as belligerent, there are the essential discrepancies between the status of belligerent deprived from service contracts and the status of PMSCs employees deprived from substantial relationship with conflicting party. Next, in case of classifying PMSCs employees as mercenaries, because mercenaries in international humanitarian law lay down illegal, it would be reached contradictory conclusion that the use of PMSCs by UN or international humanitarian organizations should be illegal. However, it would seem to be a logical conclusion in case of classifying PMSCs employees as civilians. Just in this case, because legal effects are contingent on direct participation in the hostilities, there is a preliminary consideration whether is to take part in the hostilities or not. At any rate, international humanitarian law should be harmoniously interpreted on the whole, simultaneously reality be widely used PMSCs employees should be accepted. In this view, the legal status of PMSCs would seem to be most logical in case of classifying PMSCs employees as civilians. However, as well known as, international humanitarian law such as “the Geneva Conventions” in 1949 and “the Additional Protocols” in 1977 adopted as many as 71 years ago. Meanwhile, international communities seems to change day by day such as appearance and development of PMSCs. Finally the regulation of PMSCs is insufficient today, and the practice about PMSCs also has not piled up enough. This points are same in the problem of legal status of PMSCs employees. Accordingly it is needed to conclude a treaty best reflecting general character of PMSCs. Before that, we should clearly establish the legal status of PMSCs employees based on international humanitarian law, and practices about PMSCs should pile up.
