Abstract

Article 1, Section 1 of the Constitution of the Republic of Korea states that “The Republic of Korea shall be a democratic republic.” The idea of democratic republic forms the core content of the Constitution, but different views have been presented about its concrete concept and meaning. Historically, when the concept of the democratic and the republican was first introduced in Korea in the late 19th century, it was understood as the opposite of a monarchy. In the era of the Interim Government, its concept was extended to refer to a state with Three Principles of Equality (which indicates a state based on political equality, economic equality, and educational equality). After Liberation of Korea in 1945, ‘democratic’ of the democratic republic mainly referred to a political system while ‘republic’ referred to a national system. At this period, a democratic republic was contrasted with a people’s democracy, with emphasis on division of powers. In the era of Yushin Dictatorship, the concept of the democratic republic turned into a governance tool, demanding law and order, national solidarity, among others. In 2000s, new attempts have been made to examine the meaning of a democratic republic in terms of the concept of a republic. This study views a democratic republic as a state built on the two ideologies, democracy and republicanism; democracy is the ideology in which national sovereignty is an essential political system and human dignity is an essential political philosophy. Republicanism is the ideology which accomplishes human dignity through rule of law, freedom as non-domination, and civil moral character. Democratic republicanism is the ideology which accomplishes human dignity (the highest value of the Constitution) through realization of national sovereignty with implementation of rule of law, freedom as non-domination, and civil moral character. In addition, the meaning of freedom in the principles of freedom and democracy in the Constitution should be translated in harmony with the democratic republicanism. The freedom is not a passive freedom nor a positive freedom, but freedom as non-domination. The constitutional law should provide a theoretical basis for the ideology of the Democratic Republic and for the basic conditions of democratic republicanism. Elements of the democratic republic in our constitution are guaranteed political rights, national sovereignty, electoral system, parliamentary system, plural political party system, check and balance of powers, local autonomy system, judicial independence, and others.
