Abstract

Since its establishment in 1975, the Lao People's Democratic Republic has maintained a socialist single-party political system. However, from 1986 onward, the country began introducing market economy principles, leading to increasing economic liberalization. As a result, since the late 2000s, there has been a rapid expansion in development cooperation and private-sector economic exchanges with the Republic of Korea. Given Laos’s status as a key investment destination, with a growing number of Korean enterprises entering the Lao market, there is an increasing need to understand the local labor laws and related institutional frameworks. The Lao Labor Law was initially enacted in 1990 and underwent comprehensive revisions in 2006 and 2013. The current law is composed of 17 parts and 181 articles in total. It applies to employers, registered and unregistered workers in workplaces, Lao workers employed by foreign entities, and foreign workers employed in Laos. However, it does not apply to civil servants, military personnel, or police officers working for LPRP organizations, state agencies, the Lao Front for National Development, or mass organizations. The Labor Law broadly covers the overall labor framework, including employment contracts and in-house work regulations; major working conditions such as working hours, rest days, breaks, and leaves; basic principles on minimum wage and wages; occupational safety and health and work-related accidents; protections for women and minors; employment of foreigners; labor unions and collective labor relations; and labor dispute resolution mechanisms. These provisions are supplemented by individual legal instruments enacted or amended in the form of laws passed by the National Assembly or decrees, orders, and guidelines issued by the government or prime ministerial authorities. This reflects the transitional nature of legislative development under the current political system, highlighting the need for further refinement—particularly through the independent enactment or revision of sector-specific laws by the National Assembly, accompanied by the development of relevant institutional mechanisms and detailed implementation guidelines. The Lao Labor Law has steadily evolved to strengthen worker protection. Consequently, the necessity of establishing and utilizing an effective labor inspection system has emerged. In this context, both international organizations such as the ILO and Korea’s official development assistance (ODA) programs have provided policy advisory services for improving Lao labor laws and institutions, as well as capacity-building support for Lao labor inspectors. Such initiatives should not be limited to one-off interventions, but rather be continued as part of sustained and long-term support.
