우리나라 제조물안전법의 현황과 법정책적 과제

초록

제조물안전의 확보를 통한 소비자피해를 방지하기 위하여 우리나라도 제조물책임법을 제정하였을 뿐만 아니라 소비자기본법과 제품안전기본법을 제정하여 제조물안전법제의 구축에 노력하고 있다. 그런데 제조물안전에 관한 사항을 규율하고 있는 소비자기본법과 제품안전기본법은 제조물안전기준, 사업자의 책무, 국가기관의 과제와 권한, 위해제조물의 정보공개 등에서 살펴보았듯이, 양법의 내용은 많은 점에서 중복되고 있다. 즉 제조물안전을 위한 기본법으로서 소비자기본법과 제품안전기본법이 병존하고 있는 상황이다. 그러므로 제조물안전법이 중복적으로 존재하는 상황을 극복하기 위해서는 하나의 기본법체계로 입법을 정비할 필요성이 있다. 그 방안으로 일본의 소비자보호기본법(消費者保護基本法)처럼 소비자기본법에서는 제조물안전과 관련한 원론적인 규정만을 두고, 제조물안전과 관련한 양법의 규정을 통합하는 가칭 ‘제조물안전법’이나 ‘제조물안전기본법’을 제정하는 것이 필요하다고 생각된다. 그리고 양법의 통합시에는 외국의 입법례를 참조하여 좀 더 정교한 입법을 할 필요성이 있다. 첫째로 제조물의 안전기준 설정과 관련하여 국가가 제조물의 안전기준을 설정한다는 기존의 입법방식은 제고를 요한다. 둘째로 사업자의 의무부분에서, 먼저 제조자와 유통업자의 의무를 구분해야 할 것이며, 제조자의 의무를 제조물 유통시의 의무와 유통후의 의무로 구별하여 좀 더 자세히 규정(정보공개의무, 표시의무, 조직상의 의무, 제조물관찰의무, 정보보고의무 등) 할 필요성이 있다고 할 것이다. 셋째로 제조물안전을 위한 국가기관의 과제와 권한과 관련하여서는 소비자안전을 총괄적으로 담당하는 부처의 신설과 위험있는 제조물에 대한 행정기관의 권한을 구체적으로 상세하게 규정할 필요성이 있다. 넷째로 위해제조물의 정보공개와 관련하여 정보공개를 의무적인 것으로 규정하고, 정보공개의 범위 및 공개제한의 규정을 상세히 입법하는 것도 필요하다고 생각된다.

Abstract

To prevent the damage to consumers for the sake of product safety, the government of Korea not only legislated the Product Liability Act but also legislated the Framework Act on Consumers and the Framework Act on Product Safety, thus making effort for the establishment of the Product Safety Laws. However, the Framework Act on Consumers and the Framework Act on Product Safety which regulate the matters related to the product safety are overlapping in lots of matters as seen in the standards of product safety, the responsibilities of business operator, the assignments and authorities of the related government agencies, and the disclosing of information of harmful products. Namely, there are two Acts - the Framework Act on Consumers and the Framework Act on Product Safety - as the Framework Acts for the sake of product safety. So as to overcome the situation with two product safety laws overlapping, they should be adjusted to have one product safety law. Like the Framework Act on Consumer Protection of Japan, Korea should have a Framework Act on Consumers which has only fundamental provisions related to product safety, and a Product Safety Act or a Framework Act on Product Safety, which is an integration of the two Acts concerning product safety. When integrating the two Acts, the integration should be more detailed by referring to the laws of foreign countries. First, concerning the establishment of the standards of product safety, the conventional notion that the state should establish the standards of product safety should be considered. Second, concerning the duties of the business operator, the duties of the manufacturer and the distributor should be distinguished. In addition, the duties of the manufacturer should be stipulated in more details(the duty for disclosing of information, the duty for indication, the organizational duty, the observation duty of products, the duty for reporting of information, etc.) by distinguishing the duties during the distribution of products and the duties after the distribution of products. Third, concerning the assignments and authorities of the related government agencies for the sake of product safety, a new department which is exclusively charge of consumer safety should be established, the authorities of the related administration agencies should be specifically stipulated in detail. Fourth, concerning the disclosing of information about harmful products, the disclosing of information should be stipulated as a compulsory regulation, and the scope and limitation of the information disclosure should be legislated in detail.
