데이트 폭력범죄는 친밀한 파트너의 개념으로 데이트 관계에 있는 당사자 간에 발생하는 폭력(신체적, 정서적, 언어적, 경제적 폭력 및 성폭력 등)이라는 점에서 그 심각성에 대한 인식이 부족하고 수사기관 등에서의 소극적인 대처가 최근 흉포한 범죄로 발전시키고 있다. 또한 데이트 폭력의 경우 관계 단절이 어렵다는 특징을 가지고 있어 지속적이고 반복되는 상습폭행, 더 나아가 살인에 이르기까지 잔인한 사건으로 나아가는 심각한 형태를 보이고 있다. 데이트 폭력은 다양한 폭력문화 중 가정폭력과 같이 1차적 피해 뿐 아니라 2차적 피해발생의 가능성이 높기 때문에 사회적․법률적 통제가 절실하다. 따라서 데이트 폭력범죄의 심각성에 대하여 예방교육 등을 통한 사회적 인식에 대한 변화가 필요하며, 피해자의 안전을 보장하기 위한 조치 등 수사기관의 적극적 대응이 이루어질 수 있도록 법률적 체계를 구축시켜야 할 것이다. 또한 가해자 처우 뿐 아니라 폭력의 상습성을 고려하여 사전 예방적 측면에서 피해자의 적극적인 신고와 사법기관 및 상담기관, 의료기관의 유기적인 협조체계가 제도적으로 구축되어 흉포하고 잔혹성을 보이는 데이트 폭력범죄를 감소시키는데 노력해야 할 것이다.
Abstract
The dating violence crime occurs between dating partner who is in the intimate relationship. About the seriousness of this violence(physical, emotional, verbal, financial and sexual violence, etc.), the recognition is not enough also negative action in the law enforcement agencies, etc. are developing this as the atrocious crime. In the case of dating violence, there is a characteristic that breaking the relationship is too difficult thus, continuous and repeated assaults, even murder, it shows a serious form. Among the various violence cultures, like domestic violence, the dating violence has the highest possibility of a second damage. Thus, social and legal controls are imperative. Therefore a change in the social awareness through prevention and education about the seriousness of dating violence crime are required, also action to ensure the safety of the victim, etc. establish a legal framework will be necessary to make positive response of law enforcement agencies. In addition, considering the recidivism of violence as well as the treatment of offender and as in terms of preventative, the aggressive report of victim, makes the institutional cooperation system between law enforcement agencies, consulting agencies and medical institutions are important to reduce the dating violence crime.
