Abstract
The Organizational Representation Suit and Theories of Standing to Sue of the United States are developing through the Supreme Court precedents based on the “Case or Controversy” of Article 3 of the Federal Constitution and The APA § 702. The United States has earlier recognized organizational lawsuits and has developed a wide range of them, and the scope of the plaintiffs is widely recognized. Our country is discussing the interpretation of Article 12 of the Administrative Litigation Act. Our nation has a 1:1 filing structure, so we have no room for collective action, but recently a discussion on the introduction of group action suits has been ongoing to relieve consumer damages and environmental damages. There is a difference in the traditional social system and the legal system between Korea and the United States. Therefore, it is not reasonable to reflect Organizational Representation Suit of the United States in interpreting Article 12 of Administrative Litigation Act in our country. Nevertheless, reviewing and clarifying the precedents of a judicial precedent in the United States will also aid in the interpretation of our administrative litigation on benefits. In this paper, the case theories of United States Federal Court was examined concretely concerning the concept of Organizational Representation Suit, the reason for the existence of the Organizational Representation Suit, the requirements and considerations for Organizational Representation Suit, and the qualification of the plaintiffs in Organizational Representation Suit and the possibility of expanding the nation’s collective action have been sought to expand.
