2018년 선포된 농민권리선언은 농민과 토지, 인간과 자연, 그리고 생활과 국가의 문제라는 난제들을 체계적으로 정리하면서 신자유주의적인 농업수탈체제로부터 농민이 주인이되는 사회를 만들고자 한다. 식량주권운동은 그 주요한 축을 이루는 것으로, “농민과 농촌에서 일하는 사람들”이 인권의 주체임을 선언한다. 농민을 스스로 혹은 자연과 함께 자신의 삶을 형성해 나가는 능동적⋅유권적 시민으로 자리매김하고 그렇게 살아갈 수 있는 지속가능한 역량을 구성해내고자 한다. 여기서 식량권 및 식량주권을 제도화하며 농민권리를 헌법적 차원에서 정비하는 것은무엇보다 중요한 헌법적 과제가 된다. 농업을 오로지 경제정책의 한 하위개념으로만 취급해 왔던 그동안의 우리 국가의 정책현실에 대항하여 신자유주의적 개방농정이 아니라 “지속가능한 국민농업”의 체제를 구성하거나 혹은 농업의 패러다임 자체를 바꾸어 전사회적인 법질서의 차원으로 고양하자는 논의의 연장선상에서 헌법화의 문제가 다루어지고 있는 것이다. 이 글은 이런 맥락에서 농민권리선언에 따라 식량권과 식량주권의 개념을 정리하고 그것이 농업의 다기능성이라는 특성에 맞추어 제도화되는 사례와 방향성을 검토하였다. 우선, 우리의 농업과 농민이 처한 현실을 간략히 정리하면서 그 대안으로서의 농민권리선언의 내용을 분석하고 이에 따라 우리 헌법이 어떻게 개정되어야 할 것인지를 살펴보았다. 그리고 이러한 작업을 위하여 특히 에콰도르 등 주요외국에서 농업과 농민의 권리가 헌법화되는 양상을 참조하였다.
Abstract
UN’s Declaration on the rights of peasants and other people living in rural areas The Declaration of Farmers’ Rights(2018) systematically arrange the difficulties of farmers and land, humans and nature, and problems of life and the state, and aims to create a society in which peasants are the subjects of their own lives emancipated from the neoliberal agricultural exploitation system. “The food sovereignty” movement is one of its main pillars, proclaiming that “farmers and people living and working in rural areas” be the subject of human rights. It seeks to establish the farmers as active and empowered citizens who can live their own lives with others and/or with nature. At this point, the institutionalization of rights to foods and food sovereignty as well as re-construction of the rights of peasants at the constitutional level becomes the most important constitutional task. Against the reality of Korea’s national policy, which has been treated peasants and others in rural area only as marginal people alienated from the main stream of the national economic policy, it is not a neo-liberal policy of agricultural development, but a system of sustainable national agriculture that we should keep deep in mind when we interpret and/or reform the constitutional law. There is a critical need for a paradigm shift on agriculture and rural community: we have to provide the rights of peasants and the food sovereignty with constitutional protection and support. In this context, this essay analyzed the contents of the UN Declaration on the rights of peasants, and explains the concepts of the right to food and the food sovereignty as well as the multi-functional agriculture. It examines some constitutional clauses of such foreign countries as Ecuador, Bolivia, Swiss and so on, to show how they have instutitionalized these issues on the constitutional and national level. This essay makes its conclusion with some proposals to revise the current constitution accordingly.
