NIS 지침 이행법에 의한 독일 사이버시큐리티 법제도의 변화

With the implementation of the Directive (EU) 2016/1148 of the European Parliament and of the Council of 6 July 2016 concerning measures for a high common level of security of network and information systems across the Union(NIS Directive), Germany has passed the NIS Directive Implementation Act(Gesetz zur Umsetzung der NIS-Richtlinie, Gesetzes zur Umsetzung der Richtlinie (EU)2016/1148 des Europäischen Parlaments und des Rates vom 6. Juli 2016 über Maßnahmen zur Gewährleistung eines hohen gemeinsamen Sicherheitsniveaus von Netz-und Informationssystemen in der Union) in 2017. The NIS Directive Implementation Act made new changes in the German cybersecurity legal system by the amendment of Act on the Federal Office for Information Security(BSIG, BSI-Gesetzes, Gesetz über das Bundesamt für Sicherheit in der Informationstechnik). Atomic Energy Act(Atomgesetzes, Gesetz über die friedliche Verwendung der Kernenergie und den Schutz gegen ihre Gefahren), Energy Industry Act(Energiewirtschaftsgesetzes, Gesetz über die Elektrizitäts-und Gasversorgung), Volume V of the Social Insurance Code(SGB Ⅴ, Fünften Buches Sozialgesetzbuch) and Telecommunications Act(TKG, Telekommunikationsgesetzes). A single legal framework of EU is realized in domestic legal system of Germany. The promotion of cooperation between Germany and other EU member states is institutionalized. The roles of competent authorities of cybersecurity are expanded and the cybersecurity activities of national security agencies are promoted. The condition for private entities are developed to join the cybersecurity governance. These changes suggest various implications for the improvement of cybersecurity legal system in Korea.

Abstract
