Abstract
International law of the sea is facing many challenges due to sea-level rise caused by the climate change. Possible changes of maritime jurisdiction norms are, especially, of importance to countries as national interests such as national security, international politics, and economic benefits(e.g. marine resources) are closely intertwined. However, the United Nations Convention on the Law of the Sea and customary international law have exposed limitations in properly tackling the issue as they cannot provide the guidance in reconciling two competing arguments between those who support permanent maritime boundaries and those who favor ambulatory maritime boundaries. Under these circumstances, it is highly likely that possible changes of maritime jurisdiction norms, directly related to national interests, be determined by the preference of countries. In this vein, this paper employs a law&economics model in order to analyze how maritime jurisdiction norms will be differently established as preference distributions of countries participating in the formation of multilateral treaties or customary international law are changed. In conclusion, this paper predicts that new maritime jurisdiction norms will be established in a way to secure existing maritime boundaries, considering that the majority of countries, including the U.S., have expressed their support for permanent maritime boundaries.
