직업공무원제의 제도적 변화와 균열:국가공무원법 개정을 위한 의안 분석을 중심으로

초록

이 논문은 직업공무원제를 정치적 중립, 신분보장, 실적제, 인사기구의 독립성 등 하위제도들로 구성된 일종의 퍼지집합으로 가정한다. 그리고 직업공무원제의 변화는 하위제도들이 공유하는 기본 활동의 변화하는 과정이며, 기본 활동의 주된 내용은 행정과 정치권력 간의 긴장 관계를 둘러싼 담론이라고 가정한다. 담론의 변화를 보여주는 경험 자료로서 국가공무원법 개정 의안의 분석이 보여주는 결과는 3가지다. 첫째, 정치적 중립과 인사관장기구의 독립성 사이, 그리고 실적제와 신분보장 사이에 제도적 긴장이 존재하였다. 하위제도 간의 긴장은 직업공무원제의 균열적 요소로 작용했다. 둘째, 정치권력에 의해 인사관장기구의 독립성이 위협받는 과정에서, 인사기구 스스로는 공무원의 행태를 미시적으로 관리하는 방향으로 진화해오고 있었다. 이 과정에서 실적제와 신분보장 제도가 정교해졌다. 셋째, 하위제도 간의 긴장이 균열의 임계점을 넘어서기 전에 직업공무원제의 퍼지집합 안에 등장한 고위공무원단 제도는 제도적 긴장을 완화하는 효과가 있었다.

Abstract

In Korea, Career Civil Service System (CCSS) is a basic principle for managing public officials. However, after 60 years have passed since its establishment, studies examining path of institutional change of the CCSS are limited. To explain institutional changes, this research assumes the CCSS as a fuzzy-set of institution containing its sub-institutions: political neutrality, protection of tenure, merit system, and independence of central personnel agency. These sub-institutions can interact with each other through their joint involvement in discourses about political powers and administrative authorities. By analyzing a total of 273 bills related to the State Public Officials Act proposed until the 20th National Assembly, this research provides three explanations for institutional changes. Firstly, there have been cleavages between sub-institutions. Tensions among the system have grown deeper and wider. Secondly, being an independent central personnel agency threatened by political power, the central personnel agency itself has evolved in the direction of micromanaging the behavior of public officials. In this process, sub-institutions such as merit system and protection of tenure have become more sophisticated. Finally, institutional tensions of the CCSS can be alleviated by an emergence of new sub-institutions-Senior Civil Service System in the fuzzy-set.
