이 논문에서는 감염병 위기 대응에서의 주거권 보장의 의미를 다루고자 한다. 우리나라의 헌법과 법령에 따르면, 국가는 재난을 예방하고재난이 발생한 경우 그 피해를 최소화하는 것이 기본적인 의무이다. 또한 국가는 국민이 재난으로부터 안전한 사회에서 생활할 수 있도록하여야 한다. 코로나19는 법령상으로는 제1급 감염병이며, 사회적인 재난으로 분류된다. 코로나19는 국민의 건강뿐 아니라 경제와 정치적인 상황까지 위협적인 요소가 되고 있으며, 안정적인 주거의 보장이 위협을 받고있는 실정이다. 안정적인 주거공간의 확보는 코로나19를 포함한 감염병 위기상황에서 최소한의 안전장치이다. 하지만, 기존의 주택 위기와감염병 대유행의 발생에 따른 경기침체는 세계적인 차원의 주거불안정의 위기상황을 불러올 수 있다. 감염병 대유행은 주거권 보장에 관한중요성을 환기하고 있다. 우리나라에서는 감염병의 위기 대응에서는 주거안전망의 구축에 관한 한계를 드러내고 있다. 우리나라처럼 경제적 불평등이 큰 사회에서는 주거취약계층에 대한 즉각적이고도 장기적인 적절한 주택정책이필요하다. 지난 코로나19 대유행 기간 동안 적정한 주택이 없는 사람들의 경험을 고려하면, “집에 머무르기”, “자가 격리”와 같은 정책이 실효적인 공중보건의 안전을 위한 정책이 되는 방안을 고민할 필요가 있다. 이러한 경험에서도 우리는 실질적인 주거권 보장이 선행되어야 함을인식할 수 있다. 우리는 주거취약계층에 대한 적절한 주거권을 보장함으로써, 감염병 위기 대응 이후의 주택시장에 관한 구조적이고도 혁신적인 변화를달성할 수 있도록 노력해야 하는 과제를 지니고 있다고 볼 수 있다.
Abstract
This paper tries to discuss the importance of guaranteeing preventive measures against infectious disease and housing rights. The State is to prevent disasters and to minimize damage from disasters, in the event of a disaster, and to ensure that citizens may live in a safe society from any disasters. The State perform any conduct relating to the safety of lives and physical safety. The COVID-19 pandemic incorporates a suite of health, economic and political challenges ; housing is emerging as one of them. Housing is the front line in the fight against the coronavirus disease (COVID-19) pandemic, as demonstrated by stay-at-home and lockdown orders. However, the pre-existing housing crisis and the economic downturn that followed the outbreak of the pandemic threaten to turn a public health emergency into a housing emergency of global dimensions. The pandemic has raised questions about important aspects of human rights law relating to the right to housing. One thing is certain: the COVID-19 pandemic has exposed limits in current housing safety nets, and societies with great income and wealth inequalities like the Korea need immediate long-term affordable housing solutions for poor and minority populations so that they can staysafely in their homes. The experiences of people without housing during the COVID-19 pandemic, framing stay-at-home orders as a means to co-produce public health value. We are on fronted with a challenge about how to progress housing justice post-pandemic, particularly given what is known about the need to achieve structural change in the housing market to bring about significant reform.
