Abstract
When a dispute arises due to non-fulfillment of the contract, how to resolve such dispute is one of the important decision-making matters. In particular, if such disputes occur internationally, various methods of dispute resolution exist. This study presented a model for the decision-making process that selects a dispute resolution method in a situation where different courts have different judgment tendencies. In particular, it has been shown that information on the country or social system to which a particular party in a dispute belongs can be incomplete information to the other party, and this asymmetric information situation causes opportunism, which can change the choice of methods of dispute resolution. Such a process was suggested through the calculation of deterrence benefits suggested by Hylton(2000), and the model was modified to include the problem of asymmetric information, especially since the court judgment attributes were endogenized in the calculation process of deterrence benefits. Therefore, the model presented in this study enables an in-depth understanding of the process of selecting international commercial arbitration as a means of dispute in the course of international commercial disputes.
