연혁적 고찰로 살펴본 수출통제법의 문제점과 개선방안

Abstract

In 2019, due to the outbreak of the so-called‘Korea-Japan trade war' between Korea and Japan in relation to three items: photoresist (PR), hydrogen fluoride, and fluorine polyimide (PI) used in the semiconductor and display process process. In addition,'strategic goods' and the international export control system for strategic goods and related laws are attracting public attention. In other words, the international system related to the export of strategic goods is called the “international export control system,” and the domestic laws and regulations for the implementation of such an international export control system are called the Export Control Act (ordinance) (hereinafter “the Export Control Act”). Korea's Export Control Act (ordinance) has been in operation for 33 years since 1987, focusing on the Foreign Trade Act, the Enforcement Decree of the Foreign Trade Act, and the Strategic Goods Export and Import Notification. Problems have been pointed out in various fields with respect to the Export Control Act, which has been operated as a part of the Foreign Trade Act. Therefore, by analyzing the problems pointed out about Korea's export control legislation from the perspective of the legal history, and suggesting measures to improve the legal system, focusing on the legislative system, it is intended to suggest the direction of the export control legislation in Korea.
