개헌절차의 숙의적 재구성: 공론조사 활용방안을 중심으로

종래 헌법개정 논의에서 중요하게 다루어진 것은 주로 개헌의 대상과 내용이었다. 하지만 최근에는 개헌의 실체적 내용 못지않게 개헌절차에 대해서도 관심이 높아지고 있다. 이는 아무리 개헌의 필요성과 내용 등을 다양하고 심도 있게 논한다 하더라도 막상 개헌은 쉽게 이루어지지 않기 때문에, 그렇다면 내용의 당부는 차치하고서라도 과연 어떤 절차를 통해 개헌을 관철시킬 수 있을 것인가에 대해 관심이 높아졌기 때문이고, 다른 한편으로는 헌법개정이 그동안 국회나 대통령 등 대의기관의 전속적 권한처럼 인식되고 국민참여 형태로서의 국민투표는 이들의 결정을 총체적으로, 그리고 사후적으로 추인하는 형식에 그쳤는데, 오늘날 국민이 헌법의 주인인 점은 의심의 여지가 없고 개헌은 그러한 국민의 의사를 법적으로 제도화하는 것인 만큼, 개헌절차에 국민의 참여가 단순히 형식적인 참여에 그쳐서는 안 되고, ‘숙의적 참여’로서 실질적이고 충분하게 이루어져야 한다는 문제의식이 높아지고 있다. 이처럼 개헌의 논점이 그 대상과 내용에서 절차와 주체의 문제로 옮겨지면서, 절차와 주체의 문제를 모두 포괄하는 핵심개념으로서 숙의 또는 숙의민주주의론은 개헌론에서도 중요하게 다루어져야 하며, 따라서 대의기관의 숙의는 물론이고 특히 시민의 숙의를 개헌절차에 접목하는 구체적 방법론으로서 공론조사(deliberative polling)에 대해서도 그 헌법적 좌표와 한계를 명확히 할 필요가 있다. 본 논문에서는 숙의민주주의 이론으로서 공론조사를 개발하여 그 방법론을 오랫동안 발전시켜왔고, 150건 이상의 세계적 적용사례를 가지고 있으며, 동시에 최근 우리나라에서 실험되고 있는 공론조사 사례들에도 가장 큰 영향력을 미치고 있는, 미국의 정치/커뮤니케이션학자 제임스 피쉬킨(James S. Fishkin)의 공론조사 이론에 대해 개관하고, 나아가 피쉬킨의 민주주의 연구소가 최근 직접 자문하여 제정한 몽골 공론조사법의 내용에 대해서 알아본 뒤, 이것이 실제 몽골 헌법 개정절차에 어떻게 적용되었는지를 살펴본다. 그리고 개헌절차에서 공론조사 방식을 적용함에 있어 고려해야 할 중요한 헌법이론적 쟁점에 대해 검토해보고, 마지막으로 우리나라의 개헌절차에 공론조사를 도입하여 접목할 경우 개헌절차법의 도입 형식을 통한 법적 근거 확보의 문제 및 중요하게 고려해야 할 입법적 쟁점들에 대해 검토한다.
Abstract
In the past, the subject and content of the constitutional amendment were mainly dealt with. Recently, however, interest in the constitutional amendment procedure is increasing as well as the substantive elements of the amendment. This is because no matter how in-depth the necessity and content of the amendment are discussed, the amendment is rarely passed. If so, interest has increased in how the amendment can be carried out regardless of the content request. On the other hand, constitutional amendments have been recognized as the exclusive property of representative institutions such as the National Assembly and the President, and referendums have been treated as a form of post-mortem and overall endorsement of their decisions. Now, there is a growing awareness that the people’s participation, especially ‘deliberate participation’, should be fully reflected in the constitutional amendment process as the owner of the constitution is the people. As the issue of constitutional amendment shifts from the subject and content to the issue of procedures and subjects, the theory of deliberative democracy is also dealt with importantly in the theory of constitutional amendment, and in particular, it is necessary to clarify the constitutional coordinates and limitations of deliberative polling as a specific methodology that combines citizens’ deliberations. This paper examines the theory of deliberative democracy and deliberative polling methodology for a long time, has a number of global practice cases, and at the same time has the biggest influence on recent cases of deliberative polling cases in Korea, James S. Fishkin, an American political and media communication scholar, and the use of deliberative polling in the Mongolian constitutional amendment process, which recently had a lot of influence when the Fishkin’s Lab directly consulted, and then examines constitutional theoretical issues that may be problematic in the application of deliberative polling methods in the constitutional amendment process. Finally, when a deliberative polling is introduced in our constitutional amendment process, the legal basis and major legislative issues are reviewed through the introduction of the Constitutional Amendment Procedure Act.
