부모의 자녀교육권에 대한 고찰

1980년대 후반 민주화 이후 우리 사회의 많은 부모는 자녀교육에 대한 자신의 권리에 관심을 두기 시작하였으며, 더 나아가 그 권리를 행사하는 데에도 주저하지 않는 경향이 있다. 그러나 한편 교육계 일각에서는 부모의 권리행사가 그 정도를 넘고 있다는 우려의 목소리도 있다. 이에 이 연구는 부모의 자녀교육권에 대해 보다 명료한 이해를 하도록 돕는데 목적을 두었다. 연구자는 먼저 부모의 자녀에 대한 교육권을 정당화하는 철학적 논의들을 살펴봄으로써 부모의 자녀교육권에 대한 타당성을 검토하였다. 다음으로 오늘날 한국사회에서 일반적으로 부모의 교육권을 어떻게 이해하고 있는지를 부모의 양육태도에 초점을 맞추어 살펴보고, 더 나아가 자녀 교육에 대하여 부모가 가지는 권리의 범위를 살펴봄으로써 바람직한 부모의 교육권에 대해 이해하고자 하였다. 부모의 교육권은 자녀의 교육받을 권리를 보장하기 위해 주어지는 권리이므로 자녀의 이익이 우선시되어야 함은 자명하다. 즉 부모는 자녀에게 생각, 태도, 신념 등을 주입하거나 비도덕적 방법으로 지배하고 통제해서는 안 되며, 부모의 교육권은 자녀의 흥미와 권리를 대변하는 것이어야 한다. 따라서 부모의 교육권은 자녀의 이익 즉, 자녀의 교육 받을 권리와 자녀의 행복 추구권, 자녀의 흥미, 선택권 등에 따라 존중되기도 하고 제한되기도 할 것이다.
Abstract
Since the democratization in the late 1980s, parents in South Korea have become interested in the parental rights over children’s education and they do not hesitate to exercise their rights. Although there has been increasing interest in parents’ educational rights for their children, there has also been growing confusion due to the lack of standards and understanding of the parental educational rights. In this circumstance, ‘students with long absences from school’ has lately become an important issue in our society and explains the need of a closer look concerning parents’ educational rights. Certainly, investigation and supervision are necessary if student absence is because of child abuse. If that is not the case, that is, if parents are providing their children with some kind of education even though they are not sending children to schools, can we conclude that parents are neglecting their children? Can parents have the right to choose different methods other than a public education? Looking at a bigger picture, what are the limits parents have on their children’s education? To answer this question, the study has attempted both to discuss the justification of parental rights over children’s education and to understand the meaning and scope of parental educational rights in South Korea.
