Abstract
The Financial Action Task Force (FATF) has been trying to curb money laundering and financing of terrorism, since its establishment in 1989. Its recommendations impose important duties on financial institutions as gatekeepers against criminals, including customer due diligence (CDD), record keeping, and suspicious transactions reporting (STR). The recommendations were revised to expand their scope upon legal professions in 2003. Under the revised version, so-called Designated Non-financial Business and Professions (DNFBPs) are subject to strict anti-money laundering regulation. Among others, the most controversial is the obligation of lawyers to report suspicious transactions (STR). Korea is supposed to get through mutual evaluation under the FATF system by early 2020 and needs to establish new arrangement for lawyers’ STR. This paper is to explore how the Korean government would reconcile the conflicting goal of curbing money laundering through legal professions and keeping the role of lawyers as zealous advocates of clients. Chapter II and III deals with the background of new regulation against lawyers and detailed obligations under the STR provisions. It has been reported that the criminals tend to use legal services to window-dress their illegal activities and misappropriate social reputations of lawyers. In the process of property purchase, creation of companies and trusts and management of assets, lawyers may unintentionally facilitate money laundering. The regulations on DNFBPs, therefore, focuses upon the roles of lawyers similar to those in financial institutions, including financing clients’ funds and managing and organizing clients’ assets. Chapter IV analyzes the way to introduce the STR against the traditional legal professional privileges. From the comparative law viewpoint, the US has been reluctant to adopt such any reporting obligation of lawyers while the European nations showed more flexible stance. If Korea is to adopt the STR to lawyers, an incremental and cautious approach should be taken. While the revised recommendations allow exception to the STR obligation in the case of professional secrecy and lawyer’s privilege, the requirements for those exceptions are quite vague and complicated. The main role of receiving the STR should be given to the Korean Bar Association; the detailed guidelines should be published, including when the reporting obligation is triggered and what information should be revealed; the exceptions to the obligation also be clarified. In any cases, the traditional role of lawyers to advocate their clients should not be neglected.
