미국은 2018년 8월 ‘포괄적 공동행동계획(JCPOA)’의 탈퇴를 정식적으로 발표하였다. 이란의 핵포기를 전제로 단계적 이란제재를 완화하는 것을 목적으로 구성된 JCPOA는 미국, 영국, 독일, 프랑스, 중국, 러시아와 이란이 참여한 다자적 합의이다. 당사국들이 JCPOA에 의한 의무를 문제없이 이행하고 있던 시점에서의 미국의 탈퇴선언은 국제사회에 논란을 불러 왔다. 이 글은 미국의 JCPOA 탈퇴가 북한에 주는 시사점을 알아보는 것을 그 목적으로 한다. 우선 미국의 JCPOA의 구체적인 탈퇴 배경에 대해서 알아본다. 특히 다수의 국가들 간의 합의였던 JCPOA를 탈퇴한 미국의 국내법적·국제법적 근거를 살펴보고 미국의 행위가 국가책 임에 해당하는 행위인지 여부에 대하여 알아본다. 그리고 미국의 JCPOA 탈퇴가 현재 미국 과의 3차 정상회담을 논의 중인 북한에 주는 시사점에 대해서 알아본다. 북한이 이란의 핵합의 실패로부터 어떠한 교훈을 얻을 수 있으며, 보다 실효성 있는 합의를 만들어내기 위한 방안은 무엇인지 모색한다.
Abstract
The United States formally announced in August 2018 its withdrawal from the JCPOA. JCPOA, a Joint Comprehensive Plan of Action, is a multilateral international agreement in which the parties agreed that P5+1 countries would lift the sanctions against Iran in exchange for Iran’s ceasing of its nuclear activities. Parties to the JCPOA have followed the terms of the agreement until the United States announced its withdrawal. This paper aims to analyze the cause and effect of the U.S. withdrawal from the Iran deal, and to analyze what it means for North Korea, who plans on the 3rd summit with the Unite States. The paper begins by studying the background of the withdrawal, and how the United States was able to withdraw from a multilateral international agreement such as the JCPOA without facing any legal consequences by looking at the domestic and international law. Furthermore, this paper looks at what the U.S. withdrawal from the JCPOA means for North Korea and how one might approach a nuclear deal between the North and the U.S. by analyzing the JCPOA.
