전문직 광고에 관한 공정거래법적 문제 검토

국내외를 불문하고 의사, 변호사, 회계사, 건축사, 기술사 등 소위 ‘전문직’은 전통적으로 엄격한 심사를 통하여 자격을 부여하는 대신 자치적으로 결성된 단체의 윤리규정이나 입법 등을 통하여 광고 등을 포함한 영업방식에 대하여 다양한 제한을 가하고 있다. 이러한 제한은 주로 과당경쟁으로 인한 서비스의 수준 저하를 방지한다는 측면에서 옹호되고 있으나 영업활동의 자유나 자유로운 경쟁을 제한하는 성격도 지니고 있어, 헌법상 표현의 자유 및 영업의 자유를 제한하는 것인지 여부, 독점규제 및 공정거래에 관한 법률(이하 ‘공정거래법’)에 위반하는 것인지 여부가 논의되고 있다. 근래에는 전문직 서비스 시장에 대한 경쟁 및 통상의 촉진을 이유로 종래의 여러 가지 규제들이 완화되는 국제적 추세를 보이고 있다. OECD, 미국, EU 등에서의 논의는 주로 광고 제한이 경쟁촉진에 바람직하지 않다는 입장을 취하고 있다. 따라서 우리나라에서 전문직 광고 제한 규정이 공정거래법에 위반되는지 여부를 판단함에 있어서도 이러한 시각들을 고려하여야 하겠지만, 미국 연방대법원이 California Dental Association 판결에서 ‘합리의 원칙’을 적용하여야 한다는 입장을 취한 것과 같은 맥락에서 신중하게 접근하고, 당해 전문직 서비스의 종류나 시장의 특성, 광고 제한의 내용 등을 개별적으로 고려해야할 것으로 보인다. 한편 우리나라의 현재 광고제한 제도는 주로 입법, 정부당국 및 전문직 단체의 입장이 반영되어 광고 제한이 이루어지고 있으므로, 소비자들의 입장이 반영될 수 있는 제도적 장치가 마련될 필요도 있을 것이다.
Abstract
Professionals, such as physicians or lawyers, have traditionally established rules of ethics restricting advertisements. These rules may constitute cartel or unfair method of competition under Antitrust laws. This article introduces status of advertisement restraints in professional services and relevant KFTC decisions in Korea. This article then analyses U.S. case - California Dental Association v. FTC 526 U.S. 756 (1999) - and introduce empirical studies re legal and medical advertisements in U.S. This article also introduces European Commission and OECD's stance re professional advertisements. Finally, this article suggests basic rules and perspectives determining anticompetitive effects and improving advertisement restraints under Korean Antitrust laws.
