Abstract
In case of competition law violation, victims need to get relief from the violation. However, it may be difficult to get relief from the violation due to private actions which are time consuming, costly and very complicated to the extent of damages. Many countries try improving circumstances where the victims cannot easily and rapidly get relief from the violation in competition regimes. This article will show how the United Kingdom makes policies to help the victims get relief easily and fast. Since late 1990s, the UK has discussed about how victims, small and medium-sized enterprises and consumers, from competition law violation can rapidly get relief. The UK eventually provided three kinds of way for the damage relief, enacting the Consumer Right Act of 2015. The UK has aided the victims to get efficient relief by widening the jurisdiction of the Competition Appeal Tribunal, promoting collective proceedings (including opt-out collective actions and settlements) and providing voluntary redress schemes. Especially, this article will focus more on explaining the voluntary redress schemes. In addition to the UK’s damage relief system, this article will introduce how victims from competition law violation can get relief from damage in Korea. There is similar purpose of system helping especially small and medium–sized enterprises to get efficient relief from the violation in Korea. Korea Fair Trade Mediation Agency serves a dispute settlement system in order to protect and rescue the victims. As the voluntary redress schemes and the dispute settlement have similar purpose, this article will briefly compare two damage relief systems. Finally, it would be meaningful to see how the UK’s system will work in competition regimes.
