Abstract

This article examines competition as the goals and objectives of the Korean Competition Law in the context of the ‘Economic Democracy.’ It is emphasized that the competition is not treated as the means but as the ultimate normative goal, and is also understood as the dialectical process in the diverse social values. The substantive equality of the economic interests cannot be accomplished if the ‘consumer welfare’ concept is too much absorbed and is excessively connected with the modern competition law. This perspective is what the Korean Supreme Court held in the assessment of the coordinative practices between the freighters and freight drivers’ solidarity. At the core, with the understanding that dialectics is a method of legal reasoning in which the controversies between norm are considered as inevitable and productive, it is demonstrated that the consumer welfare based on the Utilitarianism is fallacious and that the normativeness of competition is necessary to the democratic process like the Schumpeter’s creative disruption. To figure out the conflicts among social values, it roughly delineated that Sen’s social choice theory applies and the priority can be chosen.
