Abstract

Regulating the platform market in Korea, in line with the DMA poses contradictions due to four main reasons. First, there are limits within the DMA itself. The qualitative standard for gatekeepers defined in the DMA are unclear, potentially undermining legal clarity. The quantitative standard is also somewhat arbitrary, without specific grounds for the particular value. DMA designates companies with a "entrenched and durable position" as gatekeepers. However, in the rapidly changing platform market, it is highly uncertain whether companies designated as gatekeepers will maintain an entrenched and durable position. Therefore, it is unreasonable to designate future gatekeepers based solely by the current quantitative standard. Furthermore, obligations imposed on gatekeepers may actually restrict competition and innovation despite its purpose, not to mention there are insufficient evidence supporting the effect of the obligations. Also, although DMA is ex-ante regulation, it lacks clarity, and its range of regulation is based on specific companies rather than specific areas, making it inefficient. If there is a violation, the European Commission can impose a fine without defining the market or proving the anti-competitive nature of the violation, going against the principals of US antitrust laws, which considers both anti-competitive and pro-competitive effects of a violation. Secondly, it contradicts the course of Korea’s fair trade regulation. Recently, the Fair Trade Commission announced that they are considering narrowing the range of the “Same Person” in response to the deregulation demand of the business community. Considering the deregulatory course of the current situation, enacting new regulations goes against the flow of policies promoting global competitive power. Thirdly, AMCHAM mentioned digital regulations as a reason why Korea faces difficulty in attracting foreign companies despite having excellent infrastructure and living conditions. Creating additional regulations when digital regulation is already strong, hinders the attraction of foreign companies to the domestic market. The Final reason is the differences in the market structures of Europe and Korea. The main reason DMA was enacted was due to the dominance of US big tech companies in the European platform market. However, there are domestic online platform companies in Korea which are effectively competing with global companies in areas such as search engines, social media, and e-commerce. The current digital market of Korea is not a monopolistic situation. Moreover, given the relatively not-too-strong position of domestic platforms in comparison to global platforms, strong regulations will result in the weakening of domestic platforms, as the regulations will likely hold fast only to domestic companies, due to the practical limits in enforcing regulation against foreign platforms.
