'방송통신위원회 설치 및 운영에 관한 법률'에 대한 법리적 문제점에 관한 연구 : 공영방송을 중심으로

현대사회에서 방송의 독립은 다양한 국민들의 사적∙공적 의사형성을 통한 민주적 기본질서의 형성이란 측면에서 필수불가결한 민주주의의 전제조건이다. 따라서 헌법상의 기본원리인 민주주의의 형성을 위해 국가는 법제도, 제도적인 절차 그리고 조직을 방송을 통한 민주주의의 실현이라는 과제에 부합되게 형성해야 한다. 그러나 현행‘방송통신위원회의 설치 및 운영에 관한 법률’은 법률 그 자체가 방통위법의 입법형성의 정당성, 정부조직기구 형성에 있어서의 체계정당성, 위임입법의 한계일탈 등의 문제를 안고 있으며 법률안의 구체적인 내용에 있어서도 방통위의 구성과 운영, 방통 심의위원회의 운영과 구성 등과 관련해 방송, 특히 공영방송의 독립과 민영방송의 존속보장을 심각하게 침해하는 내용으로 구성되어 있어 그 개선을 위해 입법개정과 방통위법의 시행과정에서 구체적인 방송의 자유가 침해되는 경우에는 제도와 절차를 통한 방송의 독립을 위한 노력이 필요하다.
Abstract
The independence of the broadcasting is an essential condition to construct the democratic order through the free expression of private and public ideas. For this the nation have the duty of improving the current legal problem through the process and organization. But the situation of korea in the part of broadcasting ist not so simple. The recent established Act, then we so call‘ the Act of establishing and management of broadcasting and communication commission’have so many problems in the legal respect. It has so many legal problems, for example, the unfairness of making this Act, the systematic unfairness of making the government organization, the unbalance of the statute to hand over to order, etc so on. We must endeavor our best to improve and eliminate the unfairness of this Act through the amendment this act and constitutional decision to the unconstitutional paragraph of this act.
