이 논문의 우리나라 스포츠법제의 현황과 문제점 및 과제에 관하여 다루고 있다. 잘 아는 바와 같이, 현대 사회에 있어서 스포츠와 법과의 관련은 아마추어 스포츠 중심의 문화적 측면에서 프로스포츠의 발전에 따른 경제법 내지 스포츠의 산업적 측면이 부각되었다. 이에 따라 스포츠 자치법에 의한 자율적 처리 내지 법으로부터 자유로운 영역으로서 스포츠를 바라보기보다 스포츠 국가법을 통한 지원과 규제의 필요성이 강조되고 있다. 이러한 스포츠 활동과 산업의 변모현상과 관련하여, 종래의 아마추어 스포츠의 진흥을 위주로 하여 제정된 국민체육진흥법의 체계로는 한계가 있고 스포츠기본법 제정의 필요성이 강력하게 논의되고 있다. 스포츠산업에 대한 지원과 규제, 프로 스포츠의 지원육성이 새로운 스포츠 정책과제로 새롭게 인식되고 있다. 프로 스포츠에 대한 법정책적 대응의 하나로 스포츠산업진흥법이 제정되었다. 그러나 스포츠산업진흥법은 프로구단에 관한 사항이 축소되어 제정되어 불완전한 입법으로 평가되고 있다. 한편 체육시설의 설치.이용에 관한 법률은 체육시설업에 대한 행정규제를 중심으로 구성되어 있으나, 새로운 형태의 레저 스포츠의 등장으로 동법의 적용대상 체육시설과 관련하여 그 한계를 노정하고 있다. 본 연구에서는 스포츠법제 전반에 대한 현황과 과제를 모색하기보다는 스포츠 공법의 과제를 다루기로 한다. 먼저 스포츠에 관한 헌법적 논의를 다루고, 이어서 스포츠 행정법제의 중요 핵심법률인 국민체육진흥법과 체육시설의 설치.이용에 관한 법률을 중심으로 스포츠 행정법제의 현황과 과제를 살펴보기로 한다. 이 연구는 그동안 비교적 소홀히 다루어져 왔던 스포츠법제의 현상을 진단하고, 문제점과 개선방안을 모색함으로써 스포츠법제를 선진화 하는 데 기여하고 스포츠 공법을 체계화하고 정립하고자 하는 데 연구의 목적이 있다.
Abstract
This paper discusses the status, problems and challenges of sports legislation in the Republic of Korea. As widely known, the relation between sports and laws has greatly changed in modern societies: from the focusing on cultural aspects around amateur sports to the focusing on industrial aspects of sports as economic laws in parallel with advancement of professional sports. Now, therefore, sports are no longer recognized as self-governing, self-regulating and free from laws, but are required gradually to be given support on one hand and regulation on the other hand in the national legislation framework. In connection with such changes of sports activities and industries, it is widely discussed that there are limits to the National Sports Promotion Act enacted mainly for promoting amateur sports in the past and therefore, a basic act on sports is required to be legislated. Not only support and regulation for the sports industry but also aid and encouragement of professional sports get acknowledged as new sports policy agenda. The Sports Industry Promotion Act was legislated as an alternative to legal and political response to professional sports. This act, however, is evaluated as an incomplete legislation, as many matters concerning professional sports teams were cut down. In addition, the Act on Installation and Utilization of Sports Facilities was legislated around administrative regulations for sports facilities, but exposes limits to applicable sports facilities for appearance of new types of leisure and sport. This study puts more emphasis on challenges of sports laws as public law rather than on status and problems of the whole sports legislation. First of all, constitutional discussions on sports are presented, and then, status and problems of the current administrative legislation of sports are reviewed around the key administrative legislation of sports named the National Sports Promotion Act and the Installation and Utilization of Sports Facilities Act. This study intends to diagnose the present state of sports legislation dealt with relatively less attention till now, contribute to advancing sports legislation by identifying problems and seeking solutions to improvement, and also set up a public law framework for sports.
