스포츠법제의 정비에 관한 헌법적 연구

2021년은 스포츠실정법의 역사에서 한 획을 긋는 중요한 해가 되었다. 우리나라 스포츠실정법은 그동안 국민체육진흥법이 중심에 있었다. 그런데 스포츠가 발전하면서 국민의 생활 속에 파고 들어 삶의 일부분이 되면서 스포츠실정법은 해가 갈수록 늘어났다. 스포츠법학계는 오래전부터 국민의 기본권으로서 스포츠권을 보장하고 국민의 삶에 일부분이 된 스포츠의 발전과 확대를 위하여 스포츠기본법을 제정하여 스포츠법제의 정비가 필요하다고 주장하였다. 그런데도 그동안 대한체육회와 국민생활체육회의 통합으로 스포츠가 발전할 수 있다고 생각하며 국민체육진흥법 등을 개정하는 것으로 스포츠법제를 정비하였다. 최근 몇 년 동안 스포츠계는 성폭력과 폭력, 비리와 파벌싸움 등으로 부정적인 모습이 지속적으로 노출되었다. 이에 대응하여 국가는 스포츠윤리센터를 설립하는 등 노력을 기울이고 있지만, 이런 문제는 성과가 바로 나오는 것이 아니기 때문에 많은 노력이 필요하다. 이런 상황에서 십여 년 간 제정을 위하여 노력했던 스포츠기본법이 제정되었다. 그리고 국민의 스포츠활동을 위한 스포츠클럽법도 제정되었다. 스포츠분야에 중요한 법들이 제정되면서 스포츠법제는 새로운 전기를 맞게 되었다. 스포츠기본법이 제정되면서 기존의 국민체육진흥법과 체육시설법 등은 정비가 필요하게 되었다. 최근 집중적으로 개정되면서 법의 구조가 복잡하게 된 국민체육진흥법은 스포츠기본법과 관계에서 전부 개정하는 것이 필요하다. 그리고 스포츠산업진흥법과 관계에서 체육시설법도 정비하는 것이 필요하다. 그런데 무엇보다도 스포츠와 체육의 용어 정의 등을 시대의 변화에 맞게 정비하는 것이 필요하다.
Abstract
2021 marked an important year in the history of the Sports Act. The National Sports Promotion Act has been at the center of the Sports Act in Korea. However, as sports developed, they penetrated into people's lives and became a part of their lives. The sports law academia has long argued that it is necessary to reorganize the sports legislation by enacting the Sports Basic Law to ensure the right to sports as a basic right of the people and to develop and expand sports that have become a part of people's lives. Nevertheless, he thought that sports could be developed through the integration of the Korea Sports Council and the National Sports Association, and the sports legislation was revised by amending the National Sports Promotion Act. In recent years, the sports world has been continuously exposed to negative aspects such as sexual violence, violence, corruption, and factional fights. In response to this, the state is making efforts, such as establishing a sports ethics center, but this problem requires a lot of effort because results do not come out immediately. Under this circumstance, the Sports Basic Law, which had been working for more than a decade, was enacted. The Sports Club Act was also enacted for the public's sports activities. With the enactment of important laws in the field of sports, the sports legal system entered a new era. With the enactment of the Sports Framework Act, the existing National Sports Law and Sports Facilities Law needed to be overhauled. The National Sports Promotion Act, which has recently been intensively revised and has a complicated legal structure, needs to be completely amended in relation to the Basic Sports Act. It is also necessary to revise the Sports Facilities Act in relation to the Sports Industry Promotion Act. However, above all else, it is necessary to rearrange the definitions of sports and physical education in accordance with the changing times.
