2015년 8월 28일 일본에서는 ‘농업협동조합법등의 일부를 개정하는 법률안’이 가결되어 같은 해 9 월 4일 공포되었다. 이 개정법률안은 2016년 4월 1일 발효될 예정이며, 그 중 조직개편에 관한 사항은 발효일로부터 3년의 이행기간을 두었다. 개정법의 중요한 내용은 다음과 같다. 1) 지역농협은 농축산물 등의 판매사업을 통해 높은 수익성을 실현하여 경영의 건전성을 확보하고 농업인 등의 사업이용분량에 따른 배당에 노력해야 한다는 규정을 설치하였다. 2) 지역농협은 이사의 과반수를 인정농업자(認定農業者) 또는 농산물 판매 등에 실천적 능력을 갖는 자로 할 것을 규정하였다. 3) 지역농협은 그 선택에 의해 조직의 일부를 분리하여 주식회사 또는 생활협동조합으로 조직변경할 수 있는 규정을 설치하였다. 4) 전국농업협동조합중앙회(全中)는 농협법에서 삭제하여 일반사단법인으로 전환하도록 하고, 회원농협에 대한 감사기능을 폐지하였다. 5) 전국농업협동조합연합회(全農)이 그 선택에 따라서 주식회사로 조직 변경할 수 있는 규정을 설치하였다. 6) 법시행일로부터 5년이 경과하는 날까지 정부는 농협의 정조합원 및 준조합원의 조합사업 이용상황 및 농혁의 개혁에 관한 사항을 재검토하여 결론을 얻도록 한다. 위와 같은 일본의 농협법 개정은 앞으로 일본농협의 근간을 흔드는 것으로서 앞으로 우리나라의 농협제도에도 크게 영향을 미칠 것으로 보인다.
Abstract
On August 28th 2015, “Agricultural Cooperative Act to revise a part of the bill” had been enacted by Japanese House of Councilors, and was announced on September 4th. The revised Act will enter into force on April 1st 2016, and the important contents of the Act are as follows. 1) Regional Agricultural Cooperative shall distribute to farmers according to the amount of business use by achieving high profitability through the sales business of agricultural and livestock products. 2) Regional Agricultural Cooperative shall constitute majority of the directors by the admitted farmer or someone who has practical skills for sales of agricultural products. 3) Regional Agricultural Cooperative can change its organization to Stock Corporation or Life Cooperative by separating the part of the organization. 4) Zenchu shall be deleted in Agricultural Cooperative Act by converting to the General Corporation, and the audit function to member cooperatives shall be abolished. 5) Zen-Noh can change its organization to Stock Corporation The recent revision of Agricultural Cooperative Act in Japan appears to significantly affect to revision of Agricultural Cooperative Act in South Korea.
