성매매방지법의 제정과정을 대상으로 여성정책의 거버넌스를 분석하는 본 연구는 다음의 질문에 답을 구하고자 하였다. 성매매방지법의 제정을 둘러싼 ‘거버넌스’ 구조는 어떠했는가? 그러한 구조에 영향을 미친 국내ㆍ외적 환경은 무엇인가? 성매매 방지법 제정을 둘러싼 거버넌스 구조를 형성한 행위자들간의 상호작용의 양태, 영향력 관계 및 강도는 어떠했는가? 성매매방지법의 제정을 둘러싼 거버넌스 구조가 소위 ‘젠더-거버넌스’의 가능성이라는 측면에서 어떤 함의를 갖는 것일까? 연구결과 다음과 같은 함의를 발견할 수 있었다. 첫째, 성매매방지법의 제정에 있어서 국내ㆍ외적인 환경적 요소가 젠더-거버넌스 작동의 촉발적 기제로 작용했다. 둘째, 성매매방지법의 제정을 둘러싼 젠더-거버넌스 구조는 여성단체의 영향력이 지배적인 ‘시민사회 중심의 거버넌스(civil society centered governance )’로 규정될 수 있다. 셋째, 여성단체와 긴밀한 관계를 유지하면서 입법과정 전반에서 주도적 역할을 수행한 대표발의의원, 주무부처의 여성장관 및 국회 여성위원회의 활동이 주효했다는 점에서 여성의 세력화(empowerment)가 젠더-거버넌스의 가능성을 제고시키는 중요요인임을 확인 할 수 있었다. 넷째, 성매매방지법의 제정과정에서 표면적으로 강한 저항이 발견되지 않았다는 점이다. 초기 국회법사위와 법무부의 저항은 여성의원의 적극적 활동, 여성단체의 전방위 압력과 함께 최고결정권자(대통령)의 정치적 지원을 배경으로 한 여성장관의 등장으로 완화될 수 있었다. 이와 함께 제정과정이 단기간에 끝났다는 점과 법안의 심사과정에 대한 사회적 무관심-여론의 무관심을 포함한-이 역설적이게도 저항의 가능성을 감소시켰다. 그러나 제정과정의 저항의 완화가 통과이후 집행과정에서의 강한 저항으로 나타나고 있다는 점과 이러한 상황변화가 갖는 젠더-함의를 밝히는 것이 중요한 연구주제로 남는다. 한 마디로 성매매방지법을 둘러싼 젠더-거번넌스의 가능성은 환경적 요구와 여건의 변화에 대응한 행위주체들의 상황-적합적(contingent)선택에 기초한다.
Abstract
Paying attention to The Act on the Punishment Prostitution and Protection of Victims(APPPV), this article as a case study seeks to possible answers to the following questions; How was the ‘governance' structure surrounding the APPPV? What were the contextual factors, either national or international, which influence to the ‘governance' structure? What was the political dynamics for the APPPV? What were their implications for gender governance? According to the results, there are several implications for gender governance structure. First of all, national and international contextual factors such as the fire in Kunsan and taking a heavy toll of prostitutes, the general and presidential elections, international pressures against prostitution and so on acted as a strong facilitator for the APPPV. Secondly, in terms of the fact that NGOs for women issues played dominantly throughout the legislation process for the APPPV, it can be identified as the civil society centered governance. In a similar vein, the function of female femocrats such as ministers of Ministry of Gender Equality and Ministry of Justice and female members of National Assembly was vital for legislation of the APPPV. It confirmed that gender empowerment was essential for effective gender governance. Fourthly, unlike prediction, legislation of the APPPV did not meet with severe resistances from related actors. Even if there were some oppositions to the APPPV from The Legislation and Judiciary Committee and Ministry of Justice in the early stage, they were mitigated by political supports from the President, femocrats, and women's NGOs. Ironically, indifference of the general public and medias towards the APPPV contributed to the lack of resistances. In a word, gender governance surrounding the APPPV was identified as contingent choices of related actors, which responded toward contextual pressures against prostitution.
