낙태논쟁의 권리 프레임에 대한 공동체주의적 여성주의의 비판

초록

이 글은 한국의 낙태논쟁이 여성의 목소리가 미약하고 의사가 과대대표되며 법률 개정 논의에 한정되어 있다는 문제의식에서 출발한다. 그러한 한계는 이중으로 여성에게 불리한데 여성의 다양한 경험을 담지 못하고 여성을 소외시킬 뿐 아니라 낙태 선택권이 태아의 생명권을 상대로 한 여성의 권리투쟁인 양 오도되어 진보적 여성주의의 정당성을 깎아내린다. 본고는 그 이유를 논의가 미국의 낙태논쟁에서 발단한 생명이냐 선택이냐의 권리 프레임을 따른 것으로 본다. 권리 프레임이란 낙태에 접근하는 이념으로서 개인 권리, 자율성, 프라이버시와 접근법으로서 가치논의의 중지를 위한 괄호치기와 보편주의 방법론을 뜻한다. 그 틀에 제약된 프로 라이프와 프로 초이스 모두 태아와 여성의 본질에 대한 추상적 논의에 빠지고 그것에 의거한 권리의 대립적 주장에 이른다. 또 낙태를 프라이버시 즉 개인의 자유의 이름으로 옹호할 뿐 권리를 실질적으로 만들 국가의 역할을 도외시한다. 그러한 권리 프레임에 대한 비판은 낙태에 대한 보다 근본적이고 풍부한 사회정치적 담론화와 다성적 여성 목소리를 담아내는 새로운 개념체계 개발로 이어지는데 그것을 위해 본고는 마이클 샌들을 통해 낙태에 대한 실질적 가치판단의 필요성을 제기한 뒤 공동체주의의 덕이론과 포스트 계몽주의적 여성주의 윤리학에서 낙태 문제를 변형, 해체하고 두텁게 서술하는 것을 소개한다. 그럼으로써 첫째, ‘고고학적 발굴’과 해체를 통해 부모되기에 대한 프로라이프 여성의 목소리를 복원한다. 둘째, 낙태를 가족관계, 부모 자식의 열정적 애착관계 등에 재맥락화하여 태아의 지위에 대해서는 점진적 발달 관점을, 여성에 대해서는 상황 속에 위치한 숙고적 주체의 실천이성하기를 제시한다. 마지막으로 국가나 사회의 친육아적, 친가족적, 그리고 젠더평등적 전망을 가진 적절한 개입과 조건 마련을 옹호한다.

Abstract

This Article is to present a communitarian - feminist value argument to abortion dispute. In American abortion controversy, there is pro- life v. pro- choice agenda, in other word, a right framework which is consist of ideals such as right, autonomy, and privacy on one part and a way of approach such as bracket, neutrality, and universalism on the other. Critique of right framework means re-embedding the issue into contexts, concrete relationships, and material- social circumstances. Communitarian virtue theory and post-enlightenment feminist ethics give alternative interpretations of abortion and thick descriptions of them. In those theories, pro-choice women's voice can be articulate. And not individual choice, but reflexibly situated self's practical reasoning is supposed to be a rational subject's behavior. And instead of procedural republic, reasonable perfectionist state can be expected to make material condition for pro-family, gender equal structure.
