스포츠 분야는 여타 어느 분야보다 공정성이 강조되는 곳이다. 그러나 스포츠계에 있어서 공정성은 K리그 승부조작 사건으로 스포츠 정신과 페어플레이 정신이 의심받게 되었다. 특히 현직 프로축구 선수뿐만 아니라 전 국가대표 선수들도 포함되어 있어 그 충격은 가히 핵폭탄 같은 급이었다. 게다가 승부조작 사건에 가담한 자들의 구성이 전주-브로커-선수의 형식으로 체계가 잡힌 조직체와 같다는 점에서 사회적 심각성이 제기되었다. 이에 검찰은 그간 루머로만 떠돌던 승부조작의 실체를 인지하고 본격적인 수사를 통하여 40여명을 기소하여 법의 심판을 받게 하였다. 그 결과 대부분 유죄의 판결을 받았고 그 중 몇 명은 양형부당 사유로 항소하였다. 승부조작 사건으로 기소된 자들의 책임은 크게 형법적 책임과 민법적 책임으로 이분화 하여 고려해볼 수 있겠으나, 필자는 승부조작 사건 판례를 중심으로 이들에게 적용된 국민체육진흥법 규정이 아닌 형법각칙상의 책임을 논하고자 한다. 형법상 승부조작에 가담한 자들에게 행위주체별로 사기죄, 업무방해죄, 배임죄, 배임수증재죄 등을 적용할 수 있다.
Abstract
Sports is where the fairness is the first priority. However, the sportsmanship and fair play spirit have been disrupted in K-League Match-Fixing Scandal. It was tremendous shock that current professional soccer players and members of the national team were involved in the scandal. Its seriousness has been intensified as the people engaged in the match fixing seem to appear in the similar pattern with gang organization which involves financier, broker and soccer player. The prosecution service recognized the truth of the match fixing which had once been regarded as groundless rumor. After through investigation, it resulted the prosecution of 40 people and they had to be brought to justice. Liabilities of the accused should be classified into criminal liablity and civil liability. However, the author addresses the liability in criminal code based upon precedents of match fixing, not by National Sports Promotion which had been applied to the accused. Fraud, obstructing, misappropriation, and gambling would be applied to the people engaged in the match fixing by type of offenders according to the criminal law.
