헌법 개정과 스포츠기본법의 제정 방향

현대사회에서 스포츠는 인간의 삶에 중요한 요소가 되고 있다. 매스미디어는 날마다 스포츠소식을 전달하고, 스포츠산업은 해마다 더 많은 스포츠용품을 생산하여 판매한다. 우리는 스포츠경기를 관전하며 건강과 체력을 위하여 수시로 운동한다. 스포츠는 사회의 발전에 기여하고 경제에 활력소로 작용하며 점차 그 영역을 확대하고 있다. 오늘날 많은 국가는 스포츠의 발전을 위한 국가정책의 수립과 이를 뒷받침하기 위한 법제의 구축에 힘을 쏟고 있다. 스포츠의 역할이 커지면서 스포츠에 대한 국가의 책무도 커지고 있다. 스포츠는 무한한 가치로 인하여 헌법에서 다루어야 할 대상이 되었다. 이를 위하여 국가는 스포츠법을 제정･시행하고 있으며, 스포츠의 육성과 진흥을 위하여 여러 정책을 수립･추진하고 있다. 그렇지만 현행 헌법에는 스포츠권이 명문으로 규정되어 있지 않다. 헌법에서 스포츠를 하나의 기본권으로 인정하여 이를 보장하고 지원해야 활 필요성이 있다. 2008년 한국스포츠엔터테인먼트법학회는 당시 국회의 헌법 개정 논의에서 스포츠권을 국민의 기본권으로 도입할 것을 요구하였다. 그런데 헌법 개정을 위한 당시 국회 논의는 더 이상 진행되지 못하였다. 그 후에도 헌법 개정 논의는 계속되었고, 그 때마다 스포츠기본권의 헌법명문화 주장은 계속되었다. 그런데 2017년 다시 헌법 개정 논의가 시작되었고, 국회는 보다 적극적으로 개정 논의를 전개하고 있다. 물론 정당 간의 의견차이로 인하여 헌법 개정 논의가 쉽게 않을 것으로 보며, 스포츠권의 기본권화도 쉽지 않을 것이다. 스포츠기본권의 헌법 명문화와 별개로 한국스포츠엔터테인먼트법학회는 지속적으로 스포츠기본법의 제정을 통하여 스포츠관련법의 정비와 체계화를 주장하였다. 이런 학계의 요구에 정부는 여러 차례에 걸쳐 스포츠기본법의 제정을 위한 작업을 추진하였지만 구체화되지 못하였다. 우리와 달리 2013년 일본은 스포츠기본법을 제정하였다. 물론 우리나라도 대한체육회와 국민생활체육회를 통합하고 학교체육진흥법을 제정하면서 학교, 생활, 전문체육으로 나누어진 체육 분야를 정비하는 노력을 기울여 왔다. 그럼에도 스포츠분야 전체를 아우르며 스포츠의 지속적 발전을 추구하기 위한 스포츠기본법의 제정은 필요하다.
Abstract
Sports has become an essential part for people these days. Media sends out sports news every day, and sports industry is producing more sports equipments every year. People watch and do sports for health and entertainment. Sports is expanding its domain by stimulating the economy and contributing to social development. Many countries are putting efforts into establishing national policies and legal system. As sports takes on a bigger role, more responsibility is imposed on the government regarding sports. Due to its infinite value, sports has become an object of constitutional attention. The state has enacted sports law and established a number of policies to promote sports. The current Korean Constitution does not stipulate rights to sports, but it should be amended to guarantee that all people enjoys it as a basic rights. In 2006 the Korean Association of Sports and Entertainment Law called the National Assembly to introduce rights to sports when discussing amendment of the Constitution. The discussion on amendment in the National Assembly was stalled at that time, but voices that call for including sports right in the Constitution have continued to be raised even afterwards. In 2017, the National Assembly is discussing constitutional amendment again, and this time in a more active manner. There would be differences in opinions between parties regarding the amendment, hence it would not be easy to include rights to sports as the basic rights. Regardless of stipulating rights to sport in the Constitution, academia including the Korean Association of Sports and Entertainment Law has constantly advocated for legislation of a sports basic law which can integrate the current laws. The government embarked on legislation several times in response to this call, but it has not been embodied in detail. In the meanwhile, Japan legislated the Sports Basic Law in 2013. Korea has also legislated a number of laws which attempted to integrate fragmented sports policies. However, a sports basic law is in need to continuously pursue the overall development of sports.
