>학교법인정관은 해당 법인에게 있어서 최고의 자치규범임에도 불구하고, 우리나라 의 실제는 각종 내규 또는 세칙에 합당한 내용이 상당수 포함되어 있다. 이는 우리나라의 기타 법인정관 및 다른 나라의 학교법인정관 사뭇 다른 현상으로서, 그 원인은 사립학교법은 물론 초·중등교육법, 고등교육법, 학교법인정관준칙 등 교육에 관련된 각종 법령들이 정관의 내용으로는 적당하지 않은 사항들을 학교법인정관에 규정하도록 강제하는 현상이 지속적으로 증가해 왔기 때문이다. 그런데 이러한 현상은 학교법인정관의 제정과 개정에 관할청의 인가를 필요로 한다는 점에서, 정관자치의 범위 축소 또는 관할청 업무의 지나친 증가라는 문제점들을 양산하고 있다. 본 논문에서는 이러한 문제점에 착안하여 현행 학교법인정관제도를 학교법인정관의 법리에 비추어 분석하여 문제점을 도출하였으며, 그 개선방안을 모색하였다.
Abstract
The purpose of this thesis is to analyze the problem of educational foundation articles, and to present the its system which ensure private school’s particularity and autonomy, guarantee a member of the teaching staff’s position and pursue rationalization of personnel management. In chapter Ⅱ, we analyze the legal principles and the present state of educational foundation articles system. More concretely, we investigate “what is educational foundation articles”, and “what is the standing rule of educational foundation articles”. also, we compare educational foundation articles with relative concepts(school regulation, school charter, private rules of educational foundation and private school), study the types, mentioned items, supplements, and alteration of educational foundation articles. In chapter Ⅲ, we analyze the problems of the present educational foundation articles. Its results are follow. First, The regulation contents of standing rule of educational foundation articles are too much excessive. Second, standing rule of educational foundation articles regulate the articles’ autonomy. Third, the responsible parts which take charge of articles examination and its management are mixed. Fourth, whether the articles and clauses which are relative to the teacher and teaching staff in the articles contents keep or not. Finally, we present the short and long term project of educational foundation articles.
