교육거버넌스 관점에서의 시·도교육청 위원회 운영 관련 자치법규 분석

본 연구는 국가교육위원회의 출범으로 대변되는 중앙 수준에서의 교육거버넌스 흐름에 발맞추어, 시·도교육청의 각종 위원회 설치 및 운영과 관련한 자치법규가 로컬거버넌스 관점에서 효율적으로 구성되어 있는지를 분석하였다. 이를 위해 먼저 중앙 수준에서의 교육위원회 주권의 역사를 살펴보고 지방교육자치 관점에서 시·도교육청의 위원회 설치 및 운영 관련 자치법규 현황을 제시하였다. 그리고 로컬거버넌스 구성의 핵심 요소인 ‘분권화(devolution)’, ‘참여(participation)’, ‘책무성(accountability)’, ‘효과성(effectiveness)’, ‘투명성(transparency)’에 따라 시·도교육청의 각종 위원회 설치 및 운영 관련 자치법규를 분석하였다. 연구 결과, 위원회 설치 및 운영 관련 자치법규는 2024년 1월 기준 총 13개 시·도교육청에서 운영하고 있었으며, 각 로컬거버넌스 요소별 충족 정도는 일정한 경향성을 보임과 동시에 시·도교육청별 차이점도 발견되었다. 연구 결과를 바탕으로 로컬거버넌스의 취약점이 드러나는 시·도교육청의 자치법규적 보완의 필요성, 위원회 참여 주체에 대한 개방성 증진의 필요성, 참여 주체 권한에 따른 책무성의 제도화 등에 대해 제안하였다.
Abstract
This study is in line with the trend of educational governance at the central level represented by the launch of the National Board of Education. It was analyzed whether the self-government laws related to the establishment and operation of various committees of the metropolitan and provincial offices of education were efficiently structured from the perspective of local governance. To this end, we first looked at the history of the sovereignty of the Board of Education at the central level, and summarized the current status of self-government laws related to the establishment and operation of committees of the provincial and provincial offices of education from the perspective of local education autonomy. According to the core elements of the composition of local governance, 'decentralization', 'particulation', 'accountability', 'effectiveness', and 'transparency', the self-government laws related to the establishment and operation of various committees of the metropolitan and provincial offices of education were analyzed. As a result of the study, a total of 13 municipal and provincial offices of education operated self-government laws related to the establishment and operation of committees, and at the same time, there was a tendency to meet each local governance element, and at the same time, differences were found between provincial and provincial offices of education. Based on the results of the study, the need to supplement the municipal laws of education, which reveal the weaknesses of local governance, the need to increase openness to the participants of the committee, and the institutionalization of accountability according to the authority of participating subjects were discussed.
