공사중단 장기방치 건축물의 갈등 및 중단사유: 법적인 갈등을 중심으로

Abstract

As of the end of 2014, there are 417 suspended construction sites nationwide. Among them, the number of construction sites neglected for 5 years is 332, accounting for 79.6%. It can be seen that once the construction is stopped, it will be left for a long time. In the meantime, the government has enacted various laws and regulations in order to reduce the loss of various civil complaints and social and economic goods caused by the buildings that are suspended from construction. Finally, in May 2014, the Special Measures Law concerning the maintenance of buildings with long-term neglected construction was implemented. Due to the enactment of this law, the management of long-term neglected construction will be more thorough. Previous studies on the construction of long-term neglected buildings in the past have been focused on analyzing the actual conditions and problems of neglected buildings, establishing the maintenance system of the neglected buildings, establishing the maintenance plan and improving the related system. The purpose of this study is to propose a practical method to solve these problems by focusing on the legal conflicts among the causes of disconnection of the long-term-neglected buildings and to suggest ways that these buildings can be useful for the whole country and society as a whole.
