국가생명윤리심의위원회의 정책 권고 역할 강화 필요성

필자는 「생명윤리 및 안전에 관한 법률(이하 ‘생명윤리법’)」에 따라 운영되는 국가생명윤리심의 위원회(이하 ‘국가위원회’)가 국제적인 권고와 표준에 부합하고, 보건복지부의 생명윤리 기본정책과 그 시행계획에 따라 운영되기 위해서는 국가위원회에 대한 법률 규정이 “국가의 생명윤리 관련 정책의 권고와 자문에 관한 사항”을 심의한다고 개정해야 한다고 주장한다. 이를 위해 “의견 수렴을 포함한 공중의 공적 활동 지원”에 대한 사항 역시 국가위원회의 임무에 포함시켜야 한다. 이런 주장과 관련하여 그동안 쟁점이 되었던 국가위원회의 운영 성격이나 소속과 관련하여, 필자는 실행위원회가 아니라면 자문위원회냐 심의위원회냐는 사실상 중요한 차이가 아니며, 유네스코가 국가생명윤리위원회에 권고하는 바와 같이 공공정책을 수립하고 공중의 공적 참여를 통해 숙의 민주주의에 기초한 정책 수립의 플랫폼 역할을 수행하는지 여부가 중요하다고 주장한다. 소속 역시 부처 간의 갈등을 조정할 수 있으려면 대통령 소속 위원회가 적절할 수 있다. 전문성 확보 문제는 소속을 변경한다고 확보되거나 전문성에 대한 우려가 불식되는 것은 아니며, 전문위원 회와의 유기적인 연대를 통해 전문성 문제가 보완될 수 있다. 생명윤리법의 개정을 통해 위와 같이 권고와 자문 업무를 직접적으로 법률 규정에 포함시키고, 민간위원으로 구성된 국가위원회의 민간위원회가 공중의 공적 참여를 통해 사회적 합의를 바탕으로 한 정책을 권고하는 기능을 수행하며, 정부위원과 민간위원이 모두 참여하는 국가위원회의 정기회의에서 해당 권고를 의결할 것을 주장한다. 아울러, 사무국 지정만 규정한 현 규정에 “전담인력이 독립된 예산으로 사무국의 기능을 수행하게 한다”는 내용이 추가되어야 함을 주장한다. 전담인력과 독립된 예산을 바탕으로 국가위원회는 구성 초기 사업계획을 수립하고, 쟁점별로 수립된 정책 권고에 대한 보고서를 작성 하며, 설문조사 등의 여론조사와 같은 정기적인 조사 활동을 바탕으로 의견수렴과 합의안 도출에 기초한, 정책 권고 활동을 강화하여야 한다.
Abstract
This paper argues that the National Bioethics Committee, operating under Bioethics and Safety Act, must be able to recommend and consult on national bioethics policies in order to align with UNESCO’s recommendations and to operate in accordance with the Ministry of Health and Welfare’s Bioethics Basic Policy and its implemen- tation plan. Support for public engagement including gathering opinions should also be included in its duties. What matters is not whether it is an advisory committee or a review committee, but whether it functions as a platform for establishing public policy, based on deliberative democracy, through public engagement. A committee under the president may be appropriate to mediate conflicts between ministries. Expertise can be supplemented with collaboration with expert committees. The civil committee of the National Committee, composed of civil members, should perform the function of recommending policies based on social consensus. These recommendations should then be deliberated and adopted at regular meetings of the National Committee, where both government and civil members participate. Based on dedicated personnel and an independent budget, the National Committee should strengthen its policy recommen- dation activities by establishing an initial project plan, gathering opinions with regular survey activities, such as questionnaires and opinion polls, reaching a consensus, and publishing a policy recommendation report on each issue.
