Abstract

Since disputes are often resolved through litigation in the United States, the role of attorneys is very significant and the number of attorneys per capita is the highest in the world. However, pro se litigations without the assistance of attorneys are prevalent despite the higher risk of losing. There are a lot of problems associated with pro se litigations with few benefits to the people involved in litigations. First, pro se litigation comes with the low probability of winning except for the very simple matters. The pro se litigants with rightful claims and sufficient evidentiary supports are likely to lose while the opponents with the legal and technical assistance from attorneys to win, making it difficult to achieve the social justice. The increasing number of pro se litigations added the workloads and logistical burdens to the presiding judges as well as court clerks and staffs. The bench and jury trials have become more complicated to handle and delayed the trial process which made it more difficult and burdensome for the judges and jurors to make the right decisions. Pro se litigations are most damaging to the pro se litigants as their rightful claims will be unprotected. Since it is impossible to prohibit pro se litigations, it is necessary to provide the pro se litigants with the practical assistance in navigating the litigation process such as the development of Self-help or Internet programs and simplification of legal documents and forms. However, these programs cannot eliminate the inherent problems of pro se litigation since pro se litigation cannot substitute the legal representation of competent attorneys. Instead, it is necessary to reduce the number of pro se litigations by facilitating more pro bono service, unbundled legal service and legal aid program. And the courts should be more active in connecting the pro se litigants with the attorneys willing to provide pro bono services.
