서해 북방한계선(NLL)의 국제법적 쟁점 분석

이 글은 서해 북방한계선에 대한 입장을 크게 2가지(① 북방한계선을 합법적인 해상군사분계선이다. ② 북방한계선의 비합법적인 선이다.)로 구분하여 각 주장의 논리를 객관적으로 살펴보고 이들간에 국제법적으로 대립하고 있는 쟁점을 선별(①국제법 적용 가능 여부 ② 서해 북방한계선의 적용 가능 여부 ③ 서해 북방한계선의 통고 여부 ④ 황해도와 경기도의 도 경계선을 연장한 해상 군사분계선의 적용 가능 여부 ⑤ 응고이론의 적용)하여 비교 분석하였다. 분석결과로 “서해 북방한계선은 해상에서 합법적인 군사분계선 역할을 수행하고 있다”는 주장이 더 설득력이 있으며 서해 북방한계선 설정 당시의 상황과 현재까지 수행해 온 역할을 고려한다면 현재의 서해 북방한계선을 유지하는 게 합당하다고 판단한다.
Abstract
The military conflict between South Korea and North Korea has posed a real threat. Increasing tension over NLL requires an analysis on the legal status of the NLL from the perspective of international law. So, the purpose of this paper is to clarify the issues of international law on NLL. Although South Korea had to abandon the islands between the Ong-jin Peninsula and Yeon-pyeong Island, South Korea has adhered to NLL that has served as a practical way to respect The Korean Armistice Agreement(1953). Legal basis of NLL is The Korean Armistice Agreement. There is no certain evidence about notification of NLL, but it is assumed that North Korea may recognize existence of NLL by the practice of North Korea since 1953 to 2002 evidences. The provincial border line(Hwanghae-do/Gyeonggi-do) does not imply any further meaning. North Korea’s assertion about sea demarcation line could not be fully justified. Also, United Nations Convention on the Law of the Sea(UNCLOS) is not for wartime but only for peacetime. North Korea’s silence about NLL for 20 years does seem to militate with the South Korea’s argument that NLL is a de facto maritime demarcation line. Also, relevant precedent of the ICJ(Case of The Temple of Preah Vihear) supports our proposition of NLL.
