군(軍) 내 성희롱 관련 규정에 대한 비판적 검토

초록

군(軍) 내 성희롱은 이제 독자적인 불법행위로 규정되어 있다. 그러나 군(軍) 내 성희롱의 성립요건은 양성평등한 근로환경의 문제 의식에서 시작된 현행법상 성희롱 규정을 근거로 하고 있는데, 이는 위계질서의 특수성을 지닌 군과 완벽하게 양립할 수 없다. 따라서 군 조직의 특성과 군형법을 고려하여 군(軍) 내 성희롱의 개념을 정립하고, 이와 연계된 징계처벌 규정도 검토하여 군의 특성과 현실에 맞게 정비·보완되어야 한다.

Abstract

Sexual harassment in the military is now defined as an independent illegal act. However, the requirements for sexual harassment in the military are based on the current law's sexual harassment regulations, which began with the awareness of the problem of a gender-equal working environment, which are completely incompatible with the military with the specificity of the hierarchy. Therefore, the concept of sexual harassment in the military should be established in consideration of the characteristics of the military organization and the military criminal law, and disciplinary punishment regulations related to it should be reviewed and improved to suit the characteristics and reality of the military.
