외국인이라는 문제, 그리고 환대: 폴 리쾨르의 견해를 중심으로

이 글은 외국인 환대에 대한 폴 리쾨르의 견해를 분석한다. 법적인 평면에서 외국인은 우리 중 하나가 아닌 사람이다. 동시에, 원한다고 우리 중 하나가 될 수도 없는 사람이다. 이처럼 국민과 외국인의 관계는 비대칭적이다. 환대는 이러한 비대칭적인 관계 속에서, 혹은 그러한 관계를 넘어 외국인을 맞아들이는 것이다. 외국인의 유형은 단일하지 않다. 외국인은 크게, 방문자, 이주 노동자, 난민으로 구분될 수 있다. 오늘날 칸트가 말한, 타국에서 적으로 취급되지 않을 권리를 지닌 방문 외국인을 환대하는 것은 방문국의 입장에서 그렇게 어려운 문제가 아니다. 오히려 삶의 필연성으로 인해 타국으로 온, 정치적 권리가 없는 이주 노동자에 대한 환대가 사실, 칸트가 말한 권리로서의 환대 개념에 더욱 부합한다. 난민의 경우, 문제의 핵심은 국가의 주권적 선택과 난민의 보호 요청권이 충돌한다는 것이다. 여기서 환대는 난민 신청자를 심사하는 전 과정에서 그(녀)를 ‘난민으로 간주’하는 것으로, 또 신청자가 자신의 상황을 증명할 자료 제출에 심사국이 공동 주체가 되는 것으로 실천되어야 한다. 리쾨르는 환대의 실천에 이르기 위해서 우리가 단계적으로 넘어야 할 문턱들을 보여준다. 공동체의 구성원은 자신들이 지닌 귀속의 안전감이 동요되는 것을 원치 않는다. 그러나 환대에 이르기 위해서는 반드시 탈안정화의 단계를 거쳐야 한다. 여기서 핵심적인 것은 우리도 이전에 외국인이었다는 ‘상징적 기억’을 통해, 우리 자신의 외국인됨을 인식하는 것이다. 이러한 단계를 지나 우리는 외국인을 우리 자신처럼 대우하는 환대에 도달한다. 귀속의 안정성의 위협을 겪으면서 실천한 환대는 우리에게 삶은, 국민으로 사는 삶, 국가 안에 있는 삶보다 더 큰 것임을 깨닫게 한다. 우리가 법이 규정하는 대로 외국인을 바라보고 대우한다면, 우리의 삶도, 외국인의 삶도 국가의 경계에 의해 제약되는 것이다. 환대는 이런 제약을 벗어나 인간과 삶에 대한 시야를 확장하고, 깊게 한다.
Abstract
This thesis analyzes the question of the stranger. When the stranger is ‘among us,’ he / she becomes a question. In legal plane, the stranger is someone who is not one of ‘us’ and cannot be one of ‘us’ even if he / she wants to be. Like this, the relationship between the member(national) and the stranger is asymmetric. Hospitality is to welcome the stranger in, or beyond this asymmetric relationship. The types of strangers are diverse. Generally, strangers are divided into three types: the stranger as visitor, as an immigrant, and as a refugee. Hospitality should be practiced properly according to the types of strangers. It’s not difficult to be hospitable to the stranger as a visitor who, according to Kant, is considered to have the right not to be treated as an enemy. To the hospitality to immigrant-guest workers-, who does not have the political right, is the original concept of hospitality that Kant kept in mind more correspondent. To be hospitable to them, that is to say, to see and treat them as humans like us, we(nationals) have to change our mentality and legal systems. In case of refugee, his / her right to ask for protection conflicts with the sovereignty of host states. To him / her, should hospitality be done as a form of considering an applicant for refugee status as (potential) refugee during the whole procedure of verification. And host states have to work together with applicants who should submit proofs to be recognized as refugees. Ricoeur shows the thresholds which should be overcome by stages in order for us to arrive at practicing hospitality. The members of community do not want their feelings of security of belonging to be disturbed. To reach hospitality, however, we cannot but pass through the stage of destabilization. It is a core in this stage that we come to recognize ourselves as strangers through the symbolic memory which we were strangers at one time. We arrive at the hospitality through this stage. The practice of hospitality leads us to the comprehension that life is more grand than the life registered in a state. If we see and treat strangers according to the frameworks determined by national laws, our lives will remain limited within the border of a state. Hospitality broadens and deepens our view on life by freeing ourselves from this kind of limits.
