공간정보산업의 발전을 위해서는 공간정보산업 주체가 공간정보를 자유롭게 활용할 수 있는 환경이 조성되어야 한다. 그러나 이는 개인 공간정보에 대한 사생활을 침해할 위험성이 있다. 따라서 개인 공간정보의 보호에 관한 문제는 공간정보산업의 발전과 직결된 문제이다. 우리나라의 현행 법체계에서 개인 공간정보의 보호에 관한 간접적인 법령은 존재하지만 이를 직접 규율하는 법령은 존재하지 않는다. 본 연구에서는 이런 법령상 흠결에 따른 문제점을 도출하고, 선진 외국법제를 비교법적으로 고찰함으로써, 개인 공간정보 보호에 관한 발전적 개선방안을 모색하였다.
Abstract
The use of spatial information should be easily accessed to user and provider in order to develop spatial information industry. But there is a possibility to invade privacy protection because it is opened to everyone for using. Therefore, the protection of personal spatial information is directly connected to develop spatial information industry. Indirectly, Korea existing law mentioned about personal spatial information but there is no legislation directly. In this is paper, the problems in Korea legislation system are discussed and the comparative study with other developed countries are conducted to improve the protection of personal spatial information.
