본 논문의 목적은 기존 국제 반테러 레짐의 현황을 살펴보고 레짐이론의 관점에서 향후 포괄적 국제 반테러 레짐의 등장 가능성과 한국의 효율적인 대응방안을 모색하고자 하는 것이다. 국제 반테러레짐은 포괄적인 레짐이 없이 특정한 유형의 테러행위를 규제하기 위한 노력에 집중하였고, 이 때문 에 복잡하고 네트워크화 되어가는 국제테러행위를 규제하는데 한계를 가지 게 되었다. 또한 기존 국제 반테러 레짐은 예방적 차원보다는 테러가 발생 한 이후에 범죄자들의 처벌을 중심으로 논의되어 왔다. 현재 국제테러가 일 국에서 발생하였지만 다국적 영향을 미치는 사안에 대해서는 관할하지 못 하는 경우가 발생할 수 있다. 포괄적 반테러레짐을 만들려는 국제적 노력이 계속되었지만 테러개념 규 정을 두고 서구국가와 이슬람 국가가 대치하면서 결실을 보지 못하고 있다. 이슬람 국가들은 외국의 영토점령에 대한 반대활동은 테러개념에 포함 되어서는 안된다고 주장한다. 한국은 중강국(middle-power)에 맞는 전략을 개발하여 적극적으로 국제테러행위에 대응하는 것이 필요하다. 구체적으로 국제협약에 보다 참가 하여 국제협약을 수동적으로 받아들이는 국가가 아닌 적극적으로 참여하는 국가의 이미지를 강화시켜야 할 것이다. 난항을 겪고 있는 포괄적 협약의 중재안을 마련하기 위해 서구와 이슬람의 주요 학자들을 초대하여 의견을 교류할 수 있는 국제학술회의를 주관하여 한국이 창의적인 중재안을 마련 하는 노력도 필요할 것이다. 또한 우리나라가 재원의 일정부분을 충원하 여 테러방지를 위한 국제정보망을 구축하는 것도 적극적으로 검토해 볼 수 있다.
Abstract
This article studies on the development of international regimes against terrorism with international regime theory. International regime for antiterrorism was characterized as issue-specific regime and punish-oriented regime. Even though international terrorist activities are globalized and networked, international efforts to prevent international terrorism was not so well-organized. Comprehensive regime on international terrorism is critical to tackle on international terrorism. However, conflicting interests between islamic states and western states have made UN efforts in vain. Islamic states argue that resistance activity against foreign occupation should not be regarded as terrorism. It is necessary for Korea to participate actively in international antiterrorism activities. One of the suggestions of this article is hosting international conference or international academic meeting. Key figures and prominent scholars from the western and the islamic sides are invited and have chance to share theirs opinions on the definition of terrorism. Based on international conference, Korea could prepare middle way to coordinate two conflicting interests. The other suggestion is to hosting international information network center against terrorism. Information is the key factor to prevent terrorist attacks. Hosting headquarter of information network center in Korea could help national prestige of peace-loving nation.
