지적장애인 인권침해사건 해결과정에서의 딜레마에 관한질적 사례연구

이 연구는 장애인거주시설의 지적장애인 인권침해사건 해결과정에서의 딜레마를 탐색할 목적으로 수행되었다. 이를 위해 질적 사례연구방법을 활용하여 한 장애인거주시설에서 발생한 인권침해사건을 중심으로 그 사건 발생 및 대처 과정에서 나타난 딜레마를 다각도에서 규명하였다. 연구결과, 이용자 차원에서는 지적장애의 특성에 따른 자기진술능력, 자기행위 책임성과 관련된 딜레마가 도출되었다. 직원 차원에서는 정당방어의 범위, 이용자 폭력의 대처방안 부재, 동료고발에 대한 갈등과 관련된 딜레마가 도출되었다. 기관 차원에서는 이용자 대 직원 권리보장, 개인적 돌봄 대 공동생활의 특성이 딜레마로 도출되었다. 이 연구는 비록 한 기관에서 발생한 하나의 인권침해사건과 관련된 딜레마를 규명한 탐색적 연구로서의 한계를 갖는다 할지라도, 그 해결과정에서 한 기관 안에서 나타날 수 있는 다양한 인권관련딜레마를 심층적으로 논의하고 있는 점에서 실천적 함의가 크다.
Abstract
This study was aimed to explore deeply the ethical dilemmas of staffs in a residential facility for people with intellectual dilemmas. The methodology of qualitative case study was used to closely examine an incident of human rights infringement which occurred in a residential facility for people with intellectual disabilities. By this method, the contexts surrounding the occurrence of the incident and the afterward process of the case settlement were investigated. In regards to people with intellectual disabilities, the dilemma about the competency and credibility of handicapped person’s testimony and the limits of responsibility for his/her own behavior was extracted. In regards to staff, the dilemma about allowable limits of self-defense, absence of standard protocol for handling client’s use of violence, and conflicts surrounding whistle blowing was extracted. In regards to the institution, the dilemma about the confused priority of client’s versus staff’s rights, individual caring versus communal living, extension of self-determination versus compliance with community value was extracted. This study is an explorative study of a single case of human-rights infringement. Despite this limitation, it identified various dilemmas which could occur in the actual field by experience of the staff in a residential facility for people with disabilities and provided foundational data needed for further discussions in the field and in study.
