본 연구는 지적장애여성 교제폭력 피해사건을 법원의 판결문을 통해 분석함으로 써, 지적장애여성 교제폭력이 지닌 구조적 특성과 사법적 판단의 경향을 탐색하고 자 하였다. 최근 5년간 선고된 판결문 19건(11개 사건)을 대상으로 양적・질적 혼 합분석을 실시하였다. 분석 결과, 교제 중 신체적・정서적・성적 폭력이 복합적으로 나타났으며, 교제 종료 이후에도 이어지는 폭력의 시간적・관계적 연속성이 확인되었다. 특히, 피해 자의 지적장애는 폭력에 대한 인지와 신고 과정에 영향을 미치는 것으로 나타났 다. 또한, 법원은 가해자의 장애를 감경사유로, 피해자의 장애를 보호의 필요성으 로 해석하는 비대칭적 판단 경향이 나타났다. 이러한 결과는 지적장애여성의 교제 폭력이 개인적 취약성을 넘어 구조적 폭력의 맥락에서 이해되어야 함을 시사한다. 이를 바탕으로 본 연구는 향후 절차적 조력체계 구축, 피해자 권리 보장, 세분화된 양형 기준 마련, 예방 및 조기 대응을 위한 사회적 보호체계 확립의 필요성을 제 언하였다.
Abstract
This study analyzed court judgments concerning dating violence cases involving women with intellectual disabilities to explore the structural characteristics of such violence and the judicial tendencies reflected in legal reasoning. Using a mixed-methods approach, nineteen judgments (eleven cases) delivered over the past five years (2020–2025) were examined. The analysis showed that physical, emotional, and sexual violence appeared in overlapping forms during dating relationships, and the temporal and relational continuity of violence was confirmed as such harm persisted even after the relationships ended. The findings also indicated that the victim’s intellectual disability influenced her ability to recognize the violence and navigate the reporting process. In addition, the courts tended to interpret the perpetrator’s disability as a mitigating factor while framing the victim’s disability primarily as a condition that required protection, demonstrating an asymmetric and paternalistic judicial stance. These results imply that dating violence against women with intellectual disabilities should be understood not merely as a matter of individual vulnerability but within the broader context of structural and social violence. Based on these findings, this study suggests the establishment of procedural protection systems, the safeguarding of victims’ rights, the refinement of sentencing guidelines, and the strengthening of social protection systems for prevention and proactive intervention.
