지적장애여성은 무성적 존재 또는 과도하게 성적인 존재라는 이분법하에서 성폭력 피해를 인정받기 위태로운 지위에 있다. 이 논문은 장애인 성폭력 범죄에 대한 법원의 판단 경향을 검토하고 방향을 제시하는 것을 목적으로 한다. 먼저 장애여성 성폭력에 대한 여성주의의 분석을 검토한 다음, 지적장애여성 성폭력 사건의 하급심과 대법원 판결문 784건을 수집, 분석하여 법원의 주요 판단 요소들을 도출하고 판단 근거를 검토하였다. 판결문 분석 결과를 토대로 지적장애여성 성폭력 범죄의 특성을 분석함으로써, 지적장애여성 성폭력을 구성하는 본질이 장애여성 개인의 ‘손상’과 성에 대한 무지보다도 장애여성을 둘러싼 사회적 조건들, 무성적인 장애여성만을 선별하여 보호하려는 법체계와 법적 판단 태도에 있음을 지적하였다.
Abstract
Under asexuality/hypersexuality dichotomy of women with intellectual disabilities, they can hardly be recognized as victim of sexual violence. This study aims to analyze courts’ judgment trends and signpost. This thesis reviews feminist analysis on the sexual violence against women with disabilities, examines the system of sexual violence law, and reasons out the courts’ judgement factors from 784 courts’ decisions of sexual violence cases and reviews them. On the basis of the analysis of decisions, this thesis characterizes the sexual violence against women with intellectual disabilities, and points out that the ‘vulnerability’ of women with intellectual disabilities, the courts consider as a reason to protect them, comes from not only personal ‘impairments’ but social conditions around women with disabilities, all of them make sexual violence more easily.
