Abstract
A Copyright infringement litigation between Oracle and Google case is before the Supreme Court of the United States as to whether or not it recognizes the fair use of the computer program(i.e., the Application Program Interface). However, as shown in the Court of Appeals for the Federal Circuit(CAFC)’s recent decision, the determination of whether or not to allow the use of the technology-related copyrighted works is not a simple matter because the impact on the industry's ecosystem(i.e., software industry in this case) can be very large, so there must be realistic consideration based on multiple judgments. For this reason, in denying fair use in the second appeals for the Federal Circuit’s ruling on March 27, 2018, the Court itself would have stated that such conclusions and hearings were limited to the facts of the case and would not serve as a leading case for establishing the principle of fair use as a precedent for other copyright infringement disputes related to the reproduction of computer programs. As a result, the judgment of the fair use of the Java API declaration code and the duplication of Structure, Sequence, Organization(SSO) is not a matter of legal interpretation but rather a deterrence policy (i.e., monopoly of copyright) and activation policy (i.e., free use of the public) is suitable for achieving the objectives of copyright law by continually inducing creation and innovation. Starting with this issue and waiting for the final decision of the U.S. Supreme Court, in order for the ruling of the Oracle v. Google case to be a key precedent as a milestone for establishing the principle of fair use in relation to the duplication of computer programs, it is necessary to consider what is well balanced. The specific content of this paper is to suggest that the fair use judgment element should not only be judged by the works, but also that the technology and industry related to computer program works need to be considered extensively. Such an inquiry will also provide many implications in the interpretation of the subparagraphs of Article 35-3 (2) of the Copyright Act, which borrows the fair use judgment elements of title 17 of the United States Code §107. In addition, it is necessary to consider the impact on the ruling that Samsung and LG, major Korean smartphone device manufacturers, are using Google’s Android open source platform for mobile.
