블록체인을 어떻게 활용할 것인지는 블록체인의 특징을 토대로 면밀하게 분석해야 한다. 그 과정에서 장밋빛 환상은 자제할 필요가 있다. 본고는 블록체인의 탈중앙화, 작업증명이라는 두 가지 특징을 토대로 지식재산권법과의 정합성을 분석하였다. 이 과정에서 블록체인이 갖는 비용과 시간이라는 두 가지 단점을 극복할 수 있는지에 대해 고려하였다. 그 결과 지식재산권의 창설, 이전, 처분, 그리고 권리구제의 전 분야에서 지식재산권제도가 블록체인과 충돌하는 영역은 찾을 수 없었다. 다만, 블록체인은 탈중앙화된 거래환경을 제공할 수 있고, 그 중심에 스마트계약이 있으며, 이를 통해 투명한 거래의 파악과 이익분배가 가능할 수 있다는 점을 확인하였다. 아울러, 고아저작물의 이용에 블록체인을 이용할 수 있다고 생각된다. 반면, 특허권의 거래는 주로 1:1의 대면방식의 거래라는 점에서 블록체인이 갖는 장점을 발견하기 어렵다.
Abstract
How to use Block-Chain should be carefully analyzed based on the characteristics of the Block-Chain. In this process, the rosy fantasy needs to be restrained. This paper analyzed the consistency with the IPR law based on the two characteristics of decentralization of Block-Chain and proof of works. In this process, I consider whether the two disadvantages of cost and time of Block-Chain can be overcome. As a result, in all areas of the creation, transfer, disposal, and remedy of intellectual property rights, no areas of intellectual property system conflict against Block-Chain could be found. However, I confirmed that Block-Chain can provide a decentralized trading environment, and smart contracts are at the center of it, which enables transparent transactions to be identified and profit sharing. In addition, it is considered that Block-Chain can be used for orphan works. On the other hand, it is difficult to find the advantages of Block-Chain in that the trading of patent rights is mainly a 1: 1 face-to-face transaction.
